Individuals can have good performance reviews and be fired for something like drinking on the job...

I have a friend.. Young woman... Few years younger than me... Last year she needed to give a seminar to the first year students in the foreign language college...

I reminded her to point out that condoms come in different sizes... Her response was "why?"....

Yes, one notes that in the USA that they come in sizes denoted as large, extra large and XXX.

The law is pretty clear, in many states wrongful dismissal as a violation of civil rights is determined by an administrative law judge. Both employee and employer present evidence to make their case.

Perhaps the foreman explained he doesn't like q***rs and would rather fire you than watch the rest of his crew k**l you.

If one was fired because of sex, it had already become topical, eh?

The only way to deal with it then is by talking openly about it. Sometimes ad nauseam because some people have nauseating notions of how to treat fellow humans in regards to this issue.

So it's subjective?

Depending on how the judge feels...

People lie about their feelings, and motives, often deceiving themselves. Judges may determine when actions speak more loudly.

And in law, it does not matter how the judge feels as much as how they interpret and apply law.

That's where I'm having trouble...

Arbitrary guidelines and subjectivity seem counterproductive to maintaining a stable society..

In China it's legal to list age, sex, race, nationality, language, height, and other features when advertising...

A friend had a modeling agency in Beijing... Brought models from Brazil over... Was very exact about what he wanted for his customers...

Oddly, it is illegal to discriminate against sexual orientation.... But I've never heard of it being an issue...

They observe and adjudicate upon the evidence.

Where have you developed a notion that there are arbitrary guidelines and judicial subjectivity, and to what extent? It seems that you injected those assumptions into the picture and now ask others to explain it?!

And they are arbitrary. Usually a mediator appointed by the court, or even a judge makes the decision. It could even go to a jury civil trial.
