I will not argue about how it works currently, but the Framers were doing several things in the Constitution. On thing that is confusing is their use of the word Power. This one word denotes the authority assigned by the people to the Government to do the work they need done. The portion of those Powers assigned to the States, as opposed to the Federal. The Power of the Army. The power of the Police.The Power to Tax. And, the Constitutional Spheres. The basic point is that they tried to keep it pretty basic and simple. The spheres of Power probably came from a children's primmer.

In 1796 George Washington delivered his Farewell Address as he left office after two successful four year terms as President. He, more than anyone else, knew the governmental structure created by the Constitution. He chaired the convention that wrote it, and he operated it smoothly for eight years, so his observations and warnings should be taken seriously.
Washington spoke about the division of powers between the branches of the Government. He said that if they were blurred or usurped the freedoms of the people would suffer. He called them Constitutional Spheres.
Can you list the Constitutional Spheres? What is the list of powers that were divided between the Branches of Government? No one seems able to answer that question. If no one knows what is on the list, then who knows if they are divided correctly? The knowledge was lost in the fire of 1812.
To reclaim this knowledge I have searched the writings of the Founders and the Framers. They were not mentioned in the Federalist Papers or the minutes of the Constitutional Convention. They must have come in as part of the Virginia Plan.
In September of 1789 the first Congress was considering amendments to the Constitution intended to list the rights of the people. Jefferson came up with a good one. He wrote a hasty letter to Madison that described an amendment that would not allow Congress to borrow more than could be paid off in 19 years, so that one generation could not ens***e the next. Wouldn’t that be nice? At the end he said that this would go well with what they had already put into the document, specifically they took the power to declare war from the executive and gave it to the Legislature. He said, “from those who can spend; to those who can pay”. That is evidence that for Jefferson and Madison there was a clear difference between Spending and Paying and that Congress did not have the power to Spend.
Further evidence is available in every dictionary. Congress, currently, directs spending by making appropriations. But, when we look up appropriate in the dictionary we find something like this: ‘To go in without permission, and seize, particularly in a high handed manner’. They give synonyms like usurp, expropriate, and abrogate. Where could Congress act like that? They could do that in the vault over at Treasury. They are to d**g money out of the vault and give it to the President to be spent by him, not them.
So what might this list of Constitutional Spheres look like? Well, as I understand it, the Framers were trying to create an entity. Every entity needs to have certain abilities to be successful. They must be able to think and make a plan. Then they need to be able to buy what they need and hire people to put it together. They have to pay their bills, and it would be nice if they had good judgment.
This list fits the Constitution. Judgment is possessed by the Supreme Court. Buying, Receiving, Storing, T***sporting, Hiring, Assembly, etc are Executive. And, Article One; Section 7 says Congress has the power to Raise Revenue, thus they can Pay, and they can Order Resolve and V**e. What is that? V****g is a great way to make decisions, so Congress can make decisions. Resolutions are institutional memory. And, Orders are command and control. Congress has command and control of what? (The Government) Who do they give their orders to? (The President) In other words, the Framers wanted Congress to decide what the Government should do and what to spend on it, and tell the President to do it.
I liken this relationship to that of a husband and wife. She buys what she needs to have to care for the family and Daddy pays the bills. Congress is the husband, the President is the Wife. She possesses the Federal tit.
Oh but, politicians have to spend. That is how they buy political favor. To be popular and to be well funded, politicians must bring home the Federal Largess. Additionally, Raising Revenue might involve taxation, and Command and control might involve making a decision. That decision might be unpopular, and taxes are always unpopular, so politicians don’t want to do these jobs. Our Congress does not like its Constitutional Assignment. Same is true of the President. He does not want to stand around and wait until Congress decides what should be done. It is so much easier for him to design the plan and then just do it himself. But that is not what the Constitution allows.
My Dad used to tell this story: In about 1936 or 7, he said, I was in the room when the leaders of Congress, both the House and the Senate came to the White House and said, ‘Mister FDR sir, we want you to get ready for war, so you figure out what you have to do and you go ahead and do it. If you need anything, you tell us and we will get it for you. If anyone sends you a bill for anything, you send it up the hill and we will clean it up for you.’
With this statement Congress seized Spending from the President in exchange for allowing him his head.
The Founding Fathers (I believe) defined a tyrant as an autocrat who can set the agenda and then implement it. Well that is our President. And, Congress Raises the revenue and then determines who will supply all the things Government needs to buy, to do all of the things that the President wants to do. What could possibly go wrong with that system? They used to tie it to seniority and party affiliation. I remember, back in the 60’s, a Congressman asked, ‘Why shouldn’t we do this?’ No one had an immediate answer so they did it. I was in High School, so I didn’t know.
What needs to be done is to ask the Court to re-establish the division of powers specified in Article One Section 7. This involves Ministers of the Law (all of them) so the Supreme Court will have Original Jurisdiction, and all Congressmen have Standing so if a Congressman asks for it, they will hear it. All they require is: #1 a lawyer who is accustomed to arguing at the highest levels, #2 $300 for processing, and #3 Forty copies of the suit. You don’t even have to buy colored paper because this will require a white title page. It should all be very easy.
What would have been ideal is to get a decision (Unanimous?) out of the split four-four court. The question would have been, ‘Are we ready for Global Government?’ Can we drop ‘our’ Government that protects ‘us’ from all those other governmental actors out there? Looking around the world at the number of tyrants and dictators that want to ens***e us today I believe the answer is no.
John Adams, who was a sk**led British Barrister, observed that there are two ways to ens***e a free people. One is by the Sword. The other is by massive debt. I submit that by that definition we are under assault.
So if you do this, what happens next? The Politicians will not like it, so what to do? Get rid of all politicians. We have Politicians because we are required, by Article One, to V**e for our Representative. The Framers of the Constitution required this because British tradition demonstrates that V****g is a great way to make a decision, because 51% wins and carries the day, while 49% loses and the case is closed. The problem is that if you want to be represented, you do not want to be closed out, silenced, and ignored. All people must always have a seat at the table. These are the interests, concerns, and needs of real people. They must be allowed to defend themselves. (2nd Amendment)
What do I recommend that would replace our current V****g based system? I believe that each person’s Representation should be tailored, by himself, to suit his personal assessment of his needs. Each Citizen should look into himself and ask, “What do I want?” He should then look at the various groups and organizations that are willing to do the work of Congress, and choose the one whose position planks are what he would like. I expect that there will be thousands of groups wanting to represent various positions or combinations of them. All current politicians will be hired immediately, all of ‘K’ street will be included, and there will be thousand more developed over the years. Each Citizen will be able to find their perfect match, or they will be able to set up one to serve their needs.
That should solve the major problem that the Framers incorporated in to the Constitution. Others exist. Law Enforcement is done the same way the Ancient Romans used to do it. The Patent Office is a one trick pony that serves only industrialist rather than inventors. And, pay rates are set by the local labor market rather than by the value created by the worker. I have recommended solutions for all of these questions, but they will wait for another day. For today please fix it back to what it was intended to be.

My Daddy observed that a small nuclear device dropped in the ocean about one hundred miles off the coast would flood the entire coast line. That would improve lower Manhattan.

How to do that? The Framers of the Constitution addressed this issue, and solved it.
George Washington, 1796 did his Farewell from the Presidency. He warned us that, if the “Constitutional Spheres” were usurped or blurred then the freedoms of the people would suffer, as they are today.
T Jefferson reminded J Madison (Sept 1789) that they had given the Power to Spend to the Executive and the Power to Pay to the Congress. The separation is supposed to be stark. It has been blurred.
The freedoms of the People are diminished.
Call upon the Court to put the President back in charge of staying on budget, and force the Congressional Politicians to decide what the Government should do and put money together with their Orders to the Executive Branch.

My Banker’s Tax takes tax when money is taken out of the Bank Savings to be spent. 3/16/18
There are several advantages to this system. It is anonymous. It does not care who you are, what you are, what your income is, what you are buying, or why you want it. It will increase Savings. Tax is always a barrier to the flow of money so that money piles up behind it. That location, in this case, is the Saving Account. People will be encouraged to leave money in the Bank. The second advantage to this is that Savings accounts pay interest. This interest will eventually equal the tax that will be taken, so the Bank takes the tax, and also, they give the depositor the money to pay the tax. Thus I call it the Bankers Tax.
Banker’s Tax has another benefit. It has a very low percentage tax rate, because it is ‘double counted’. Every t***saction is taxed. The same product is taxed several times as it travels through the distribution chain. This is true for Imports and local consumption, but Exports leave us tax free. That is because foreigners don’t use US bank accounts that charge US taxes. They pay for what they are buying out of their foreign bank accounts. When we buy something as an Import, we pay from a US bank account so the importer pays tax, then the distributor/wholesaler pay tax, the retailer pays tax and then the customer pays again. This allows a low rate, 5%. With tax on markup and multiple t***sactions the tax take should be close to 30% of the original manufacturer’s cost of the product.
It also offers another benefit. If it is required, to pay tax on barter, and Cash and Gold can be considered as having multiple t***sactions before they return to a bank, then we can charge several layers of tax, 20%. And, the final customer can avoid several layers of tax, and markup associated with distribution, by buying direct from the producer. This will stimulate local production. This is a national defense issue, because when there is a disruption to the distribution system, the local producers will cover the short fall. Add to that the increase in savings, and we will be considerably more durable and resilient.
President Trump outlined the weakness of Income Tax when compared to Value Added Tax. He said that our products are taxed 15% going into Mexico, while their products come into the US at no cost. That is the effect of VAT tax compared to our Income Tax system. This needs to be fixed. I don’t know what the numbers are now, but years ago we lost $200 Billion in Europe, and another $300 Billion in China. Then there is the rest of the world. We are bleeding badly. We subsidize Europe. We have been being swindled for seventy years. Please fix this problem.
