What happens when an administration refuses to hold its officials accountable for deceiving Congress?

Eventually Congress starts looking for ways to hold them accountable directly.

The Department of Justice has already made clear that it won’t enforce warrants issued by Congress, so Rep. Jim Jordan (R-OH) wants to use the tools the US Constitution provides.

Jordan tells Steve Doocy this morning that he wants to impeach one such official, IRS Commissioner John Koskinen, for ongoing deceptions in the probe of political targeting by the tax-exempt review department (via Daniel Halper):



Perhaps this is more of a question of priorities, but why start with Koskinen?

The IRS chief has certainly angered people with his special blend of arrogance and incompetence, but he wasn’t at the IRS when the abuses took place.

Koskinen got appointed in the wake of some rare head-rolling at IRS after the exposure of the political targeting of conservatives. Removing Koskinen — or at least making him the first example of Congressional power — seems out of place while James Clapper remains the Director of National Intelligence.

Clapper flat-out lied to Congress, and did so repeatedly, when asked about the nature of NSA’s operations. Clapper later even admitted he hadn’t told the whole t***h, deliberately keeping critical information about executive-branch abuses from the oversight of the legislative branch.

Those lies dealt with a much more bipartisan issue, and primarily angered Democrats ahead of Republicans at first, who certainly got more vocal about it after Edward Snowden began revealing the nature of NSA domestic trawling.

Despite this, Barack Obama has not even hinted that he’d replace Clapper despite his obstruction of Congress and the serious damage done to both constitutional oversight and intelligence operations by Clapper’s actions (and inactions for that matter, when it comes to Snowden).

That is by far the greater insult, and no one has yet attempted so much as a censure, let alone an impeachment.

Koskinen isn’t exactly small potatoes, but if Congress wants to flex its muscle, let’s start where the most damage has been done — and send a message that will ring louder and longer.

There are 15 emails that Mr. Blumenthal gave to the House committee looking into the 2012 attacks in B******i, Libya, that the State Department cannot find among the emails that Mrs. Clinton handed over last year, according to a State Department official.

The House committee gave those emails to the State Department this month. A spokesman for Mrs. Clinton did not return an email seeking comment.

5 Things About People Who Remain Uninsured Despite ObamaCare.

The landmark 2010 Affordable Care Act was passed on the premise that more than 50 million Americans didn’t have health insurance, and needed it.

Five years in, it’s helped some, and passed over others–some of whom have chosen not to get insurance even thought the law makes it possible for them to do so.


1. There are lots of them:

Between 16 and 17 million people have gained health insurance as a result of the health law, most studies have concluded.

About 35 million remain uninsured, according to the Congressional Budget Office, a number that is set to dip to 26 million by 2019.



2. They're not who you think they are:

CBO says that by the time everything has shaken out, around 30% of the remaining uninsured will be unauthorized immigrants.

Another 20% will be people eligible for Medicaid who choose not to enroll, and about 5% will be people who were supposed to be eligible for Medicaid under the health law but don’t qualify because their state opted not to expand the program.

The single largest group — 45% – will be people who have access to insurance through an employer or could buy it on their own because of the law but have chosen not to.


3. It's not about politics:

When people say why they’re choosing to remain uninsured, their reasons are almost always financial — not political.

A study by pollster Mike Perry, commissioned by backers of the law, found that in almost eight out of ten cases, people concluded after considering everything that they were better off not spending money on insurance.

For many, money was tight, and paying debts, putting away savings and repairing a home or car all ranked ahead of getting health insurance when they are doing better.

The Journal also found examples of people who were comfortably off and just preferred to act as their own insurer.



4. They've really thought it through:

Mr. Perry’s study found that a large number of the uninsured had checked out their options on HealthCare.gov or a state site and weighed the cost of the plans’ premiums and deductibles against subsidies to offset those premiums and the penalty for going uninsured before they made their final decision.


5. They're getting care in other ways:

The uninsured still get health care — and that’s part of the reason they often don’t feel desperate about forgoing coverage. They find doctors and hospitals who take cash, and sometimes haggle for the price.

They participate in discount drug programs, buy cheap natural remedies, and sometimes even get care while they’re overseas.

And if they run into really big problems paying for care, they turn to emergency rooms, free clinics and charity programs that treat them and write off their bills — which works for them, although it has implications for everyone else.

Well, the guys in the black robes have chosen statism over freedom once again – Obamacare is upheld in the Supreme Court. How can people be free when they are dependent on the government for their very health?

I for one am not surprised at the ruling. After all who benefits? Certainly not you and I, because the individual has no lobby that can match the lobbies of big insurance, big Pharma and big hospital associations.

Who benefits? Well, hospital stocks surged 8 percent at the news of Obamacare being upheld. And just a few weeks ago (in anticipation of Obamacare being upheld?), I got a notice from Blue Cross and Blue Shield that my health premium was going up 24 percent – and that’s on top of the previous years’ raises of about 30 percent.

Big Pharma benefits as medicine prices rise astronomically.

Even my cat’s vet noted that the medicines he uses on animals have increased vastly in cost. In the case of a sedating agent, one he has used for decades, the price went from $8 a vial to over $40 a vial – if he can get it at all. The veterinarians, like we physicians, are seeing shortages previously unknown.

Why is all this happening?

Because monopolies always cause price increases and shortages. A free market fills demand with supply. Econ 101. And Obamacare – read Medicare on Steroids – is a government monopoly on medical care.

The hospitals are clearly in bed with the Obamacare oligarchs and expect to profit. Witness the Wall Street response.

And let’s call this what it really is – f*****m. F*****m is by definition an economic arrangement wherein government partners with private industries, choosing winners and losers.

Governments under f*****m control their economy and ultimately the behavior of their citizens through taxation and regulation.

The individual appears to have ownership of his property, but is limited in its use due to government regulations.




Every CEO of every hospital in America should read “Hell’s Cartel” by Diarmuid Jeffreys. It is the sad history of IG Farben – the German company that was, at the beginning of World War II, the largest chemical conglomerate in the world. Before Hitler was elected, the N**is kept knocking on the door of the board of IG Farben asking for contributions.

The board was comprised of mostly chemical engineers who were generally apolitical. But they got tired of the constant begging for money, so to make them go away the CEO of Farben gave the N**is a pretty good chunk of Deutschmarks, thinking they wouldn’t bother him any more. And in the off chance the N**is would win, then he thought IG Farben would have a seat at the table. (Where have we heard that reasoning?)

Lest anyone think the actions of an individual firm don’t count, the result was the tragedy of World War II because that single contribution really made the N**i win possible – they were down and out without that infusion of cash. But beyond that was the economic and moral outcome of the company.

At first, IG Farben – now a favorite son of the N**i regime – prospered. Government money poured into armaments, and chemical plants were on overdrive. The Farben guys probably plugged their ears eyes and nose while they picked up the money, but pick up the money they did – by the bucketful.

One of the small subsidiaries of IG Farben was Degesch – a small company that made insecticides. By the end of the war, 85 percent of the profit of IG Farben came from one chemical – Zyklon B.

Zyklon B was used to Gas and K**l over 6 Million Jews, in the N**i Concentration Extermination Camps.

Now, in spite of later denials, the company chiefs clearly knew what the N**is used the Zyklon B for. By the end of the war, one of the board members of Farben was literally stepping over dead bodies at Auschwitz to obtain measurements for a new synthetic rubber plant.

But Degesch (and its big motherhouse Farben) had a choice: They could keep producing Zyklon B and thereby stay afloat and return profit for their shareholders, which they did, or they could have chosen not to further produce the gas for the death chambers and go under – and maybe incur the fatal wrath of the N**i regime.

On balance, the entire profit made by cooperation with the government was certainly overshadowed by the destruction the company endured. Not a few of its workers and families were k**led by war.

Board members’ sons were not spared. Some of the chiefs ended up in prison (the head of Degesch receiving five years and others the death penalty), and the company was seen to be culpable for crimes against humanity.



Now, why do I bring this up?



Like Degesch, 75-85 percent of income to hospitals comes in various forms from the federal government.

Those dollars are already coming with strings and regulations upon regulations.



The one difference between Obamacare and Medicare is that Medicare was socialism by stealth.



But the Obamacare architects make no bones about their desire to see a one-party national health type payment system a la Britain or Canada.

And the money expended for medical care under such a system – much like the German system in WWII – is done on the basis of age and productivity. Even the U.N. has complained that such systems k**l old people by neglect.

So what will your local hospital do when the government decrees that they will no longer pay for t***sferring 90-year-olds to higher level care? Maybe they will accept that.

Then the age will be 85, then 75 – then maybe they will not pay for any treatment for a 90-year-old, or people who are not productive.




Well, you get the picture. When you no longer pay taxes but are a debit to the government ledger, what will they deem you are worth?

And will hospitals just keep going along with all this to get along and stay afloat?

Or will they recognize that this is not just about money and regulations but that they and their actions have moral consequences?

Will the CEOs and CFOs stand on principle for their patients?

I see no evidence generally of the latter. In today’s world, when the choice is compliance with money coming in or non-compliance with the money drying up, hospital systems continue to bed with the government to the detriment of quality health care.

Sadly, I do not see us ending well for the American elderly.



I do not see medical care being given in the future according to the sacred principles of Hippocrates – to put patients before all else, to do the best you can for the patient and not for some nebulous third-party payer or social entity.

I just attended a medical school graduation where the graduating doctors took an oath that included the oath to patient privacy. But I knew, if they did not, that the oath now means nothing.

The minute they start their internships, they will begin putting all their patients’ most private information into an electronic database that is pumped out to unelected government bureaucrats who have no allegiance to patient privacy.

We citizens, doctors and patients must give up our own handouts and recognize that a medical system based on theft of one individual for the benefit of another is immoral.




We must recognize the inherent evil in medical utilitarianism wherein. I can sacrifice your care for the greater good of more or younger people.




We must not ask the government for health care or any other subsidy, but instead restore freedom by saying no to government schemes, by unelecting the oligarchs and again embracing the principles of free market economics in medicine and in all facets of life.

The one difference between Zyklon B used to K**l over 6 Million Jews, and ObamaCare, MediCare is that MediCare is socialism by stealth and will decide American elderly people who are not productive, and not pay for medical procedure or palliative care.

Then at what age will ObamaCare, MediCare will not pay for any treatment for a 90-year-old, or people who are not productive.




Well, you get the picture. When you no longer pay taxes but are a debit to the government ledger, what will they deem you are worth?

6/25/15 IRS Deleted Hundreds of Back-up Tapes Containing Thousands of Lerner Emails After Congressional Subpeona Was Issued

This used to be called obstruction of justice and tampering with evidence. 

According to new information from the House Oversight Committee, Treasury Inspector General for Tax Administration [TIGTA] Russell George and Deputy Inspector General for Investigations Tim Camus, the IRS deleted hundreds of backup tapes containing thousands of emails belonging to former IRS official Lois Lerner, the woman at the center of the conservative targeting scandal.

The tapes were destroyed nine months after a congressional subpoena was issued to the agency demanding they be preserved and turned over. 

"As Ms. Lerner’s hard drive could not be recovered and the 422 tapes most likely to have contained Ms. Lerner’s e-mails from 2010 and 2011 were erased in March 2014, we were unable to recover all of the missing e-mails.

Comparing the IRS e-mail t***saction logs to the IRS production to the Congress revealed there could be as many as 23,000 to 24,000 additional missing e-mails.

As a result of the investigative process, TIGTA was successful in recovering over 1,000 e-mails that the IRS did not produce to the Congress, DOJ, or TIGTA. The investigation also revealed that prior to our investigation and our efforts to recover Ms. Lerner’s missing emails.

The IRS did not search for, review or examine the two separate sources of backup tapes, the server hard drives, or the loaner laptops that ultimately produced new, previously undisclosed emails," George said during congressional testimony Thursday.

According George, 24,000 Lerner emails were destroyed. By the way, Lerner's hard drive "crashed" on a Saturday, the same week the House Ways and Means Committee sent the IRS a letter inquiring about the agency targeting conservatives.

Rand Paul is poised to become the first major p**********l candidate in memory to sue the government he seeks to lead as president.

The Kentucky senator will take legal action against the U.S. Treasury and the Internal Revenue Service for what he says is the denial of his constitutional right to v**e on more than 100 tax-information treaties that the Obama administration unilaterally negotiated with foreign governments, The Washington Times has learned.

In what the suit says is a violation of Article II, Section 2 of the Constitution, President Obama has not consulted the U.S. Senate about the treaties nor given the Senate an opportunity to approve or disapprove of the treaties. The administration calls them “intergovernmental agreements.” They require foreign banks to gather and share private financial information about millions of

Americans living and working outside the U.S. — information they would not have to disclose to the U.S. government if they lived and worked in the U.S.

The treaties or agreements are the enforcement mechanisms of the Obama administration’s Foreign Account Tax Compliance Act (FATCA), enacted by a Democratic-controlled Congress in 2010.

The act is despised by many of the estimated 8.7 million Americans living overseas, a record number of whom have — with great anger and reluctance, according to those who have spoken to the foreign and U.S. press — renounced their U.S. citizenship rather than attempt to comply with FATCA.

What percentage of them simply want to evade paying taxes to the U.S. government and to the foreign governments in whose countries they work and/or reside is unknown. The U.S. is one of the few countries that taxes its citizens on income earned and property held both at home and abroad.

President Obama pushed for the passage of FATCA as a means of capturing hundreds of millions of dollars in income and property taxes owed to the Treasury by those Americans living and working outside the U.S. But many Americans living abroad say the Treasury and the IRS are treating them as guilty of tax evasion until proven innocent.

“Obama owns this,” said Indiana-based GOP superlawyer Jim Bopp, the lead attorney for Mr. Paul and other plaintiffs in the case. “FATCA passed Congress right after Obama was elected, when the Democrats had majorities in both houses” of Congress.

“The issue is inescapably partisan for that reason and for the fact that no Republican [in the U.S. House] supported the passage of FATCA,” Mr. Bopp said. “The U.S. government didn’t start enforcing it until Obama started to target U.S. citizens overseas in the belief that they had a lot of money but not a lot of political clout sufficient to fight back.”

Nations that have approved these bilateral agreements or treaties with the U.S. include such major economic powers as China, Britain, India, Israel, Ireland, Canada, Australia, Japan, Germany, France, Spain and Switzerland, as well smaller states once considered as tax havens such as Bermuda, the British Virgin Islands, Lichtenstein and Luxembourg.

So far, 112 nations have agreed to collect or receive private financial information about Americans in those countries and to turn the information over to the U.S. government.

Constitutional clash

Mr. Paul, a Republican who announced his p**********l bid in early April, will join six other plaintiffs in the suit that a new organization called “Republicans Overseas Action” expects to file in a southern Ohio federal district court the week of June 29. The court’s Republican makeup is considered at least open to the constitutional arguments that the plaintiffs lay out.

The other plaintiffs base their claim of legal standing to sue the Treasury and the IRS on FATCA’s requirement that they surrender personal information in violation of the Fourth Amendment’s ban on unreasonable search and seizure and on the Eighth Amendment ban on cruel and unusual punishments — in this case, unusually large financial penalties for late filings, however innocent, or for noncooperation.

FATCA requires foreign banks to violate the privacy of their American customers by disclosing bank balances and all financial t***sactions. The U.S. law levies a hefty 30 percent fine on foreign financial institutions that don’t cooperate with the Treasury’s requests.

The fine is actually levied against the American customer of the foreign bank, but critics say no bank can keep its customer base with fines of that magnitude.

The law also directly fines the American holder of a foreign account as much as 50 percent of the highest balance that was in that account at any time during a 12-month period as penalty for not reporting.

Mr. Paul’s suit argues that the administration purposely avoided calling the arrangements “treaties” and instead labeled them as “intergovernmental agreements” to escape having to get Senate approval. Earlier this year, Mr. Paul introduced a Senate bill to repeal FATCA. But Senate Majority Leader Mitch McConnell has not scheduled debate on the bill.

Michael DeSombre, an American residing in Hong Kong, is the worldwide president for Republicans Overseas Action. He sees Democratic presumptive nominee Hillary Rodham Clinton as vulnerable on the FATCA controversy.
“When FATCA was enacted in 2010, Hillary Clinton was secretary of state. Many overseas Americans complained how unjust and destructive this law is to U.S. embassies and consulate general offices around the world. What I want to know is what did Hillary do with those reports in this e******n,” said Mr. DeSombre.

The other plaintiffs in the suit Mr. Paul has joined say they have been denied banking and financial services in the foreign countries where they live and work. The foreign banks don’t want to be burdened with the expense and paperwork to comply with FATCA and therefore simply refuse to accept Americans as clients.

The Republican National Committee and the recently formed Republican Overseas Action aim to get as many of those Americans living or working outside their country to register in one or another of the swing states that decide the presidency in close e******ns. The driving force behind the suit is a longtime conservative activist on the Republican National Committee, Solomon Yue of Oregon.

“The best way to defend 8.7 million overseas Americans’ right to privacy and constitutional protections is to cripple the IRS, FATCA and enforcement tools through legal action on constitutional grounds all the way to the U.S. Supreme Court,” said Mr. Yue, founder and vice chairman of Republicans Overseas Action Inc.

WASHINGTON — A one-digit correction to President Obama's directive on hostage policy Wednesday had the effect of disclosing the existence of a previously unknown — and still-secret — Obama order on national security.

The hostage policy was originally released Wednesday as a p**********l policy directive numbered PPD-29. When the White House corrected that number to PPD-30, it meant Obama had issued a secret directive as PPD-29 sometime in the past 17 months.

Obama signed PPD-28, an order on electronic eavesdropping in the wake of revelations by Edward Snowden, in January 2014.

So what is PPD-29? No one's talking. A spokesman for the National Security Council declined to comment of the existence of classified PPDs Wednesday.

"The difference is that while executive orders are public by law — they must be published in the Federal Register to be effective —- PPDs are not," he said. "It is a kind of secret law. People have to obey it. But it's a directive that can allocate money, direct people or take a course of action."

What Obama calls PPDs have gone by different names by different presidents back to the Truman Administration. President George W. Bush called them National Security P**********l Directives (NPSDs).

President Clinton called them P**********l Decision Directives (PDDs). President Nixon called them National Security Decision Memoranda.

Wh**ever they're called, Obama issued 30 PPD, 11 PSD directives and 27 EO directives, issued 68 all totaled. Some, going back as far as the Lyndon Johnson administration, remain classified. They can involve subjects including the use of nuclear weapons, ballistic missile defenses, space policy, cybersecurity and even continuity plans for the federal government in the case of a large-scale disaster.

The secrecy makes it difficult to know entirely what changes Obama has made in the hostage policy. The directive issued Wednesday revoked a prior directive by President George W. Bush in 2002. But that directive, known as NSPD-12, remains secret.

"You would think that if there's a new policy it would be a simple matter to explain what the old policy was," Aftergood said.

And even though Obama released his directive, it incorporates a classified annex with additional instructions to executive branch agencies. These PPD and PSD orders could have far greater effects than previous presidents combined, thats why they are secret.
