Rules for Radicals, Communications chapter begins on page 81. Perhaps a rereading of it would be worth your refreshing as you are becoming ineffective.

You did read that article before posting it, right?
First off, the FBI is still investigating this. The FBI does not investigate servers or devices....they investigate crimes.
They are the ones to make the recommendation for indictment.
That is the fact. What you posted was an opinion article.
