I mean , you really do want Certified Meat Inspectors inspecting your Meat, right ?
You don’t really want ex CEOs of pharmaceutical companies heading up your CDC?
You don’t really want ex CEO of Exxon heading the Environmental Agency, like Rex Tillerson ? Right ?

The topic is about Biden’s overuse of EOs and the deserved push back. Not Trump’s misuse “milosia”.

Well, Trump was not impeached the first time and it doesn't look to happen this time either. There was impeachment proceedings, but it failed, so no impeachment!

Yes, I did, so you can unkindly shut up. The only thing irrelevant here are your inane comments.

Lol how about you educate yourself. Trump has been impeached twice, the only one in history that can say that. He may not have been removed from office the first time, but he most certainly was impeached in the House twice.

Red States Pushing Back on Biden’s Executive Orders
Stu CvrkFeb 02, 2021 4:00 PM ET

In an unprecedented flurry of authoritarian activity for a new president, the Hologram has signed 43 executive orders in his first dozen days in office. This from someone who as a candidate claimed that “Trump was a dictator” in signing various executive orders, as noted here:

“I’ve got to get the votes,” said then-candidate Biden.

“I have this strange notion, we are a democracy … if you can’t get the votes … you can’t [legislate] by executive order unless you’re a dictator. We’re a democracy. We need consensus,” said Biden.

Yet, it is abundantly clear that Biden is essentially ruling by diktat in reversing dozens of Trump policies – from canceling the Keystone XL Pipeline to enabling “transgenders” in the armed forces to opening the border (and ceasing construction of the wall) to rejoining the Paris Climate Accords. Others being contemplated could involve curbing Second Amendment rights, a return to the Obama-era Joint Comprehensive Plan of Action (JCPOA) with Iran, new politically-oriented domestic terrorism laws, and curbing First Amendment rights including protected political speech on social media.

Many Americans are greatly concerned by the increasing suppression of constitutional rights, as publicly trumpeted by Biden apparatchiks and supporters in the legacy media. Big Tech leftists have already “canceled” the social media upstart Parler and suspended thousands of social media accounts of conservatives and Trump supporters. Some Biden supporters, including this PBS lawyer (!) – have even clamored for “reeducation camps” for Trump supporters. And this is just the tip of the iceberg, as the Left are emboldened in these actions because the Biden Administration is entirely sympathetic. How does the secret Democrat-led Senate ethics panel going after Sen. Ted Cruz (R-TX) and Sen. Josh Hawley (R-MO) for challenging Biden’s Electoral College “win” (as reported here) comport with the Democrats’ pursuit of “unity”? The goal is THEIR definition of unity, which involves suppression of all dissension at all costs. Because their definition decidedly does NOT mean consensus or compromising with Republicans. Always remember that their word definitions are not commonly understood definitions but rather are twisted to service their political objectives!

Back to Biden’s EOs. First of all, executive orders are NOT laws but rather are “pseudo laws,” as explained by the American Bar Association here:

An executive order is a signed, written, and published directive from the President of the United States that manages operations of the federal government. They are numbered consecutively, so executive orders may be referenced by their assigned number, or their topic.

Executive orders are not legislation; they require no approval from Congress, and Congress cannot simply overturn them. Congress may pass legislation that might make it difficult, or even impossible, to carry out the order, such as removing funding. Only a sitting U.S. President may overturn an existing executive order by issuing another executive order to that effect.

[However,] … executive orders … have the force of law, much like regulations issued by federal agencies, so they are codified under Title 3 of the Code of Federal Regulations.

Because EOs have “the force of law” similar to federal rules generated by the administrative state, some Red States have begun to push back. In Texas, Attorney General Ken Paxton (R) filed a lawsuit to stop implementation of an executive order that directs a halt to all deportations of illegal aliens during Biden’s first 100 days as president:

According to Paxton, the freeze violates the Constitution and is a violation of federal immigration and administrative law as well as an agreement between the State of Texas and the Department of Homeland Security.

And a federal judge subsequently blocked implementation of that executive order, as reported here. Hurrah for a little Republican lawfare for a change after four years of Democrat filings before friendly leftist judges to thwart President Trump’s actions!

But that is not all of the push back that is underway. In South Dakota, a state representative introduced a bill that would enable the state attorney general to review and reject presidential executive orders that violate the Constitution:

The bill takes a broad view, stating that no executive order may be implemented “that restricts a person’s rights.”

The proposed bill would also allow the attorney general to block implementation of any order deemed unconstitutional if the order refers to:

A pandemic or other public health emergency

The regulation of natural resources

The regulation of the agricultural industry

The regulation of land use

The regulation of the financial sector through the imposition of environmental, social, or governance standards

The regulation of the constitutional right to keep and bear arms

Excellent! Protection of constitutional rights is vital to the preservation of our constitutional Republic. The Biden administration policy objectives that curtail constitutional rights of Americans must be halted and reversed. Executive orders are ruling by diktat, not by consensus. It is the responsibility of the US Congress to write laws, not the Executive Branch. Executive orders are another manifestation of the administrative state – in this case by the Office of the President, bypassing Congress to implement policy through “pseudo law.” The practice has gotten out of hand and needs to be curtailed. More states need to pursue what South Dakota is doing.

Actually this approach would be great if enough states stood together, but that is unlikely to happen. Most of our states now are so filled with foreign non-citizens and leftist/socialist/no borders/democrats that the change to blue has already happened or is close, as just happened to my state. If there are more of them than us, we cannot change anything. And, it is very likely that by the end of this era of the Democrats being in power, everything will be much much worse than now.

NEWS
Biden Is Putting Migrant Kids In Cages And Now ‘AOC’ Doesn’t Care.
FEBRUARY 3, 2021RAHEEM KASSAM

Joe Biden is re-opening a child migrant detention center, but neither the establishment media nor left-wing politicians appear to care. The response is starkly different from when President Trump operated the detention centers he inherited from the Obama-Biden administration.

The move is said to be a direct result of the relaxation of border enforcement, a stunning admission made in CNN reports.

The Biden administration is opening an overflow facility for unaccompanied migrant children apprehended at the US-Mexico border, the federal agency tasked with the children’s care told CNN in a statement.

The Health and Human Services Department will reopen a facility in Carrizo Springs, Texas, that can accommodate about 700 children and can be expanded if necessary.

The reopening of the facility comes amid an increase in apprehensions of unaccompanied children on the Southwest border, fueled in part by deteriorating conditions in Latin America and a perceived possible relaxation of enforcement, and reduced capacity limits at other facilities due to Covid-19. It also comes as President Joe Biden rolls out new immigration executive orders tackling migration to the US southern border.

The silence from the national, establishment media as well as Democrats on Capitol Hill has been notable.

Once known for crying at a fence overlooking a parking lot, Congresswoman Alexandria Ocasio-Cortez has – at the time of publication – said nothing about Biden’s new move to “put kids in cages.”

National advocacy groups are also silent, and outlets such as the New York Times and CNN have failed to criticize Biden and his regime for re-opening the center and congregating migrant children in close conditions.

Perhaps the most important part of why these centers need to reopen in the first instance is the most important: the relaxation of enforcement. In other words, Joe Biden has signaled for people to come, illegally, into the United States.

When they arrive, he’s putting them in detention centers.

Daniel Horowitz: Enough Is Enough; ‘Red States Must Nullify Biden’s Nullification of the Constitution’

The following story is brought to you courtesy of Red State.

Given Joe Biden’s affinity for firing off executive orders as fast as they’re shoved in front of him — along with accompanying index cards that he’s supposed to read aloud so both he and the rest of us can know what he’s signing — the question of “constitutional” — or the lack thereof — is increasingly under debate, and with good reason.

Daniel Horowitz, the senior editor of TheBlaze and host of the Conservative Review podcast, took the argument a step further in a Monday op-ed titled “Red States Must Nullify Biden’s Nullification of the Constitution.”

“What happens when the federal government and some state governments turn against every provision of the Constitution, Bill of Rights, and Declaration of Independence?” Horowitz asked, then answered:

“James Madison foresaw such a day, which is why he designed a multilayered republic with numerous states and counties all under a federal union. Tyranny and lawlessness can persist in some places, but under his design, it shouldn’t persist fully in every part of the country.”

“When the federal government chooses to nullify the Constitution, it’s time for the remaining lawful states to nullify the nullification,” he wrote.

Horowitz suggested that the Biden administration, with the more-than-willing help of the liberal media and blue-state governors, imposed “COVID fascism” on the country, “criminalize[d] free speech and assembly,” and “misuse[d] and abuse[d] our military for what appears to be a fascist junta in D.C.”, while “rolling out the welcome mat” for “rioters in our streets,” and illegal aliens at our border.

“We should be asking ourselves,” he said, “what red states and counties can be doing to push back.” Among his suggestions for the 31 Republican state legislatures:

“Block Biden’s mask mandate: Conservatives should push an immediate end to all state mask mandates in the 31 states where Republicans control the legislature.

“Next, in the states with Republican governors and attorneys general, they should take a chapter out of New York’s playbook by criminalizing the enforcement of Biden’s mask mandate on public transportation.

“Biden’s order makes it a federal crime to breathe freely even in a ride-share that doesn’t go across state lines. This is unconstitutional on so many levels. It’s time to criminalize the enforcement of this in the states. […]

“Call back the National Guard: The deployment of our National Guard to Washington was a disgrace from day one and was done under false pretenses. The fact that Biden is keeping them there indefinitely is indefensible.

“It is shocking that only eight Republican governors have called back their National Guardsmen, despite them being abused. Pressure needs to be brought to bear on the remainder of those governors to follow suit.”

As reported by CBS News, Army and National Guard officials said last Monday that 5,000 National Guard troops will stay in Washington, D.C., until mid-March in response to “requests and information from other agencies, including the FBI.”

To Horowitz’s point, why?

Discrimination against Trump supporters.

From the permanent suspension of Donald Trump’s Twitter account, along with some 70,000 others, to the de-platforming of Parler by Amazon Web Services, and growing threats of suppression of conservative content on multiple social media platforms, Horowitz says it’s time to fight back — seriously so.

“Fight discrimination against Trump supporters: The federal government has now harnessed the full force of law enforcement and the national intelligence apparatus against Trump supporters.

“States must commit to blocking federal law enforcement from arresting people merely for assembling or expressing their opinions.

“They should also file 14th Amendment lawsuits against federal agencies that clearly single out Trump supporters for questioning and investigations.”

Horowitz also called on Republican state legislatures to “immediately terminate all emergency orders” and “pass restrictions on the ability of governors to abuse emergency powers” — as well as “criminalizing the entry of men into female private spaces and women’s sports so that Biden’s unconstitutional order cannot take root in the majority of states.”

Horowitz also discussed Biden’s “unconstitutional overreach” on his last podcast.

In related news, as I reported on Saturday in ‘Cut Constitutional Corners’: Six Red State AGs Threaten to Sue Biden for ‘Overreaching and Defying Congress’, the attorneys general of Arkansas, Indiana, Mississippi, Montana, Texas, and West Virginia sent a direct and to the point letter to Biden last week, warning that they will file suit if he oversteps his constitutional authority and attempts to implement radical policies, including repeal of existing immigration laws.

“The President cannot cut constitutional corners or shirk statutory strictures without inevitably doing more harm to our country than good. [B]y this letter we respectfully urge you when pursuing your policy priorities to honor the core constitutional tenets which should be appreciated and respected by every person entrusted with the honor and burdens of the presidency.”

As of Friday night, Biden had signed 42 executive orders, dwarfing the combined efforts of the previous three presidents combined. At the end of their respective first weeks in office, Donald Trump had signed four, Barack Obama, five, and George W. Bush, 0.
