1. Does Trump have a Constitutional right to nominate someone to fill the vacancy on the SCOTUS before the election?
2. Does the Senate have the Constitutional right to advise, and consent to the nomination without regard to the election?
3. In 2016 did the Senate have the Constitutional right to advise Obama as a lame duck President not to make a nomination at that time?
4. In 2016 should the Republican run Senate have used a different reason to block Obama's nomination, rather than claiming it was an election year and the people should be allowed to vote on the issue?

Well depends on how you look at it ,you look at it one way ,,yes obama had the right to appoint a justice, even though he was a lame duck, spin it anyway you want

In 2016 President Obama was a lame duck President with no chance of re-election. He also had a Republican Senate which wouldn't have confirmed any appointment sent them.
In 2020 President Trump has a good chance of re-election and he has a Republican Senate which may or may not approve an appointment sent to them. Apples and oranges. Mike

Avoiding the question
It's okay to admit that the Republicans shouldn't have used that explanation in 2016...
Politics is chalk full of hypocrisy and gotcha moments

All's fair in love and war bro. Obama didn't have the votes in the Senate. Period.
Canckus, Like in 2016 when Obama said that the Constitution says that the President shall nominatre, and the Senate shall confirm Supreme Court Justices. He said that the Constitution DOES NOT SAY, Unless it's an Election year!
As long as Republicans accept that this makes them hypocrites I have no issue with it...
We care not what anyone makes of this. It's our war and the "Republicans" are doing what we're making them do. You don't actually think the spineless worms would show initiative on their own, do you?

Since when do the people have a right to vote for Supreme Court justice?
