The Arby’s Employees Who Refused To Serve A Cop Just Got A BIG Reality Check

At a time when America’s police officers are facing unprecedented antagonism on the streets of the cities they patrol, the Arby’s fast food chain has reacted strongly to an incident at a Florida store in which a police officer was refused service. The clerk involved has been suspended and his manager has been fired, Arby’s spokesman Jason Rollins said Thursday.

Additionally, Arby’s announced that on Friday, it would provide a free combo meal to any uniformed officer in the Broward and Miami-Dade areas.

The incident had sparked strong reaction in the embattled law enforcement community.

“It is beyond comprehension and deeply troubling that a business would deny service to a law enforcement officer just for being a law enforcement officer,” John Rivera, the president of the Miami-Dade Police Union, had said in a statement earlier in the week that called for a boycott of Arby’s. “This is yet another example of the hostile treatment of our brave men and women simply because they wear a badge. It is unacceptable and warrants much more than an apology.”

Arby’s got the message.

“As soon as the issue was brought to our attention, our CEO spoke with the Police Chief who expressed his gratitude for our quick action and indicated the case is closed,” Arby’s said in a Wednesday statement. “We will be following up with our team members to be sure that our policy of inclusion is understood and adhered to. Further, we will be following through with disciplinary action up to and including termination of the employees involved, as appropriate.”

As a result, Manager Angel Mirabal, 22, and clerk Kenneth Davenport, 19, were both disciplined for their roles in the Tuesday night incident in which Pembroke Pines Police Sgt. Jennifer Martin, ordered a meal at the drive-thru.

Davenport, “seemed slightly rude and short with his responses,” according to an incident report filed by Martin.

“He doesn’t want to serve you because you are a police officer,” Mirabal told Martin when she pulled up to the window to pay for her food, according to the report.

Davenport was ordered to process Martin’s credit card, the report said. It added that Martin told Mirabal she felt uncomfortable and wasn’t certain she wanted to eat there. She initially accepted Mirabal’s assurances that there was no problem, the report said. Then things got worse.

“Mirabal even laughed and said he is allowed to refuse to serve me,” Martin said in the report.

After that, Martin reported that she felt uncertain of the condition of her food. She went inside to get a refund. Once inside Davenport refused contact with Martin and refused to provide his contact information.

As the incident gained attention, Davenport on Wednesday told the media the comment had been an attempt at a joke “We don’t hate cops,” Davenport said. “We don’t hate anybody. We’re just trying to get people out of the drive-thru.”

Pembroke Pines Police Chief Dan Giustino said the incident was not indicative of the support the department receives from the community.

“We are very proud of the partnerships we have built within our city,” Giustino said. “For an incident like this to have happened is very disappointing for everyone.”
