Are there any attorneys on here familiar with constitutional law? I need to pick you brain for an upcoming court case, as I just know my public pretender will tell me to plead guilty. Any help would be greatly appreciated.

Why does it not surprise me you would have an upcoming criminal case? And less you are depending on a public defender?

Why does it not surprise me that you would have something nasty to say? First of all, I didn't break the law. Second, it's a misdemeanor if I'm convicted. If I am convicted, I believe that it would be a violation of my first Amendment rights. Now crawl back under your rock, you filthy troll.

If you are not guilty, especially if it is not a felony tell them you want a jury trial. They don’t like them because it takes their time and costs them more than they collect in fines and costs. If you are guilty beg borrow and steal to hire a lawyer. What are you on the hook for?

Lighten up, I was expressing a sense of humor, glad to hear it's just a misdemeanor...

but really, 1st amendment, that would be saying something offensive, otherwise known as lip service paid that crossed a line?

What did you say, cough it up...and I will admit to the general direction of this thread has has me laughing in a good way. Have fun with it, I'm sure the details have their humorous points, I can just tell.

On the flip side, pushing that can trigger full penalties if you lose, and often charges of things that violates statutes are enough black and white that there is not much chance of substantiating not guilty when you were, you just don't agree with the legality.

We would have to know more here...Lol

If you have to know, I was cited for loitering. Alabama code 13a-11-9. It's only four days if I plead guilty. But I've been informed that if they grant a trial and I lose, I'll get more time added. That's why I'm asking for advice. I've heard about asking for a trial. How sure are you that they'll dismiss it?

Basically, I was displaying a sign with a Bible verse on it while sitting down and resting because I'm disabled. The cop said I could sit there all day if I got rid of the sign. So, basically, he wrote me a citation for displaying a sign with a Bible verse on it. I'm no constitutional lawyer, but I believe that violates my first amendment rights of freedom of religion and freedom of speech.

I looked it up. Apparently you cannot request a jury trial if the punishment is less than 6 months in jail.😠

I wonder if I should just plead guilty, do the four days (free room and board) then file a civil right case. Can you do that?

Here in Placerville, which is a highly republican county and law officers, bible verses associated with Jesus h**es f*gs were getting the book thrown at the people with those signs on their trucks.

Your verse was perhaps controversial?
