It actually is in some places, possibly because the cigarettes could have drugs or poison in them. somehow I doubt if it is ever enforced.

Yes, there is a different standard. Selling bootleg cigarettes that have not paid the taxes is a crime. The state will lose money so they will go after you like a rabid IRS agent.
What the protestors are doing it not laudable, it is necessary. The protestors are exercising their First Amendment rights. These are the people's rights, not the government's. Nothing illegal in what they are doing because they are exercising their civil disobedience and right to throw off tyranny by a governor. CA could be next if Newsom doesn't wise up very quickly.
When tyranny becomes law, rebellion becomes a duty.
