The Constitution makes several references to what a president can and cannot do, and to say a president cannot be charged with a crime while sitting would undermine the premise that no man including the president is above the law. The likely road is impeachment first, and then indictments, and the right is blindly running on the premise that as long as republicans are in control this will never happen. If evidence of crimes by Trump come out, republicans will be called on to do the job they were elected to do, which is to protect the laws and constitution. If they fail to do that they will be in violation of carrying out their sworn oaths. Hard cold evidence is going to rule here, which is why the right is so aggressively trying to undermine the justice department.

Look, we know that the liberal cable news networks are your universities, the sock puppets are your professors, Salon, HuffPo, Daily Kos and other leftist websites constitute your library. Unfortunately your universities do not offer a rigorous course curriculum nor provide texts and study materials, the subject matter is fluid, subject to whimsical change, and often contradictory. You are not assigned homework or administered any exams, oral or written. Fundamentally, they teach you what to think rather than how to think. And they do not award diplomas or degrees. So, it is no surprise that you would believe that the DOJ memorandums were something fabricated by FoxNews.

The DOJ Office of Legal Counsel and the Solicitor General issued memorandums specifically regarding the unconstitutionality of indicting a sitting president. They issued these memos in 1973 (Nixon admin), and again in 2000 (Clinton admin). Nixon, BTW, resigned due to threat of IMPEACHMENT, not criminal prosecution.

Department of Justice Memorandum: A Sitting Presidents Amenability to Indictment and Criminal Prosecution

In 1973, the Department concluded that the indictment or criminal prosecution of a sitting President would impermissibly undermine the capacity of the executive branch to perform its constitutionally assigned functions. We have been asked to summarize and review the analysis provided in support of that conclusion, and to consider whether any subsequent developments in the law lead us today to reconsider and modify or disavow that determination. We believe that the conclu­sion reached by the Department in 1973 still represents the best interpretation of the Constitution.

The US Constitution prescribes that Impeachment is the only lawful means by which a president can be removed from office. IF an impeachment of a president is successful and he is duly and lawfully removed from office, his legal status then is private citizen and he can then be charged with a crime.

It's not the deed, it's the continually repeated lies that are the worst part.

The difference between Hillary being a liar and this kind of lie is the amount of evidence and corroboration involved. Cohen says that Trump was told in a setting where several other people were there and heard it as well.

So for the right, the constant rhetorical litany of fake news, witch hunt, deep state is all being proven to be the BS it is.

Time to change gears, say okay, so he knew, it's not that big a deal. It is a huge deal, it is collusion, which is illegal to collude with an adversary nation like Russia, it is conspiring with a country that was known to be hacking and interfering in our election.

This actually completely illegitimizes Trump's presidency. And it does not matter whether it can be proved whether Russia had an effect. This is the smoking gun on collusion to know Russia was offering up stolen election sensitive information on Hillary.

This also completely changes Trump's announcement a few days earlier that there would be startling information on Hillary leaked if it can be proven that he knew about it.
