The Constitution makes several references to what a president can and cannot do, and to say a president cannot be charged with a crime while sitting would undermine the premise that no man including the president is above the law. The likely road is impeachment first, and then indictments, and the right is blindly running on the premise that as long as republicans are in control this will never happen. If evidence of crimes by Trump come out, republicans will be called on to do the job they were elected to do, which is to protect the laws and constitution. If they fail to do that they will be in violation of carrying out their sworn oaths. Hard cold evidence is going to rule here, which is why the right is so aggressively trying to undermine the justice department.

They issued these memos in 1973 (Nixon admin), and again in 2000 (Clinton admin). Nixon, BTW, resigned due to threat of IMPEACHMENT, not criminal prosecution.
