Stump v. Sparkman (1978)
Main article: Stump v. Sparkman
One of the leading decisions on judicial immunity is Stump v. Sparkman. In 1971, Judge Harold D. Stump granted a mother's petition to have a tubal ligation performed on her 15-year-old daughter, whom the mother alleged was "somewhat r****ded". The daughter was told that the surgery was to remove her appendix. In 1975 the daughter, going by her then-married name of Linda Sparkman, learned that she had been sterilized. She sued the judge. The U.S. Supreme Court ruled that the judge could not be sued, because the decision was made in the course of his duties. In that regard, it was irrelevant that the judge's decision may have been contrary to law and morally reprehensible.

Harris v. Harvey (1979)
Main article: Harris v. Harvey (1979)
One significant case where a judge was sued and did not receive immunity is Harris v. Harvey.[20][21] Sylvester Harris, an African-American police lieutenant in Racine, Wisconsin, was attacked in a variety of ways by Judge Richard G. Harvey. Harris sued Harvey because of (a) comments Harvey made to the news media, (b) threatening letters Harvey wrote to city and county officials who attempted to defend Harris, and (c) parties Harvey held for ranking state officials during which he attempted to get Harris removed from law enforcement. The jury concluded that Harvey was not eligible for judicial immunity for these actions, as such acts were not part of the judge's normal duties (i.e. they were "outside his jurisdiction"). The jury awarded Harris $260,000 in damages. Another judge later added $7,500 in legal fees. The United States Court of Appeals for the Seventh Circuit concurred with the jury's decision. Judge Harvey petitioned the Seventh Circuit court for an en banc rehearing, and petitioned to the Supreme Court, both of which were denied. Harris v. Harvey is the first case in the United States where a sitting court judge has been sued and lost in a civil action; it is a binding precedent in the Seventh Circuit and is persuasive authority in the other circuits.[22][23][24]

Supreme Court of Virginia v. Consumers Union (1980)
In Supreme Court of Virginia v. Consumers Union (1980), the U.S. Supreme Court ruled that the Supreme Court of Virginia did not have immunity from being enjoined in its enforcement capacity where state law gave the court independent authority to initiate certain proceedings against attorneys.[25] Consumers Union was hindered in compiling an attorney directory because many attorneys declined to provide information for fear of violating regulations promulgated by the Supreme Court of Virginia. Consumers Union filed a lawsuit in federal court against the Supreme Court of Virginia and others, under 42 U.S.C. § 1983, seeking to have the regulation declared unconstitutional and to enjoin the defendants from enforcing it.[26] The U.S. Supreme Court affirmed the Supreme Court of Virginia's possession of legislative immunity in some cases, however.[27]

Mireles v. Waco (1991)
In the case of Mireles v. Waco (1991),[28] when a defense lawyer failed to appear for a scheduled hearing, the judge not only issued a bench warrant for his arrest, but instructed the police sent to arrest him to "rough him up a little" to teach him not to skip court dates. Although this was entirely unprofessional and possibly criminal, the judge was held, by the Supreme Court, to have absolute immunity from a lawsuit arising from the resulting beating, because the misbehavior occurred entirely within his activities as a judge presiding over a court.

My wife and I were talking tonight about the state of this country and how deplorable it has become and while we generally agree for once she agreed with just about every word I said. The division in this country is 100% due to right-wing media whether it's on the radio or watching cable TV and if not for what is said in those cesspools we would be a similar nation as we were before the advent of the Rush Limbaughs, Fox News, and those who have worked so hard in copying them.

I remember the 60's, the 70's, and even into the 80's and there wasn't the hardened h**e that conservatives had for liberals as you do now. But talk to Blade Runner and he thinks liberals are the greatest evil this country has ever produced and I am willing to believe that if asked, everyone of MAGA would agree with him. H**e that ground-in doesn't happen all by itself. It's preached and reinforced by every venue that it experiences. And the fact that most of you are Christians and you hold that much h**e for so many of your neighbors and it should abhor you...but it doesn't.

Now if you are going to say that my experience, or the average experience of a Democrat is the same you are wrong! This is really going to shock you but the average Democrat gets their news from one of the Big Three or PBS and there is never an angry word said about Trump or anyone in the Republican party. Why do I say that, because the FAA, which is the same under Republicans as it is under Democrats would smash them like a little bug if they did demean or denigrate anyone? And I know you are going to jump up and down screaming Donald Trump tell you nearly blow your little brains out but telling the t***h about someone isn't demeaning or denigrating someone.

This is why I'm pointing my finger at Right-Wing media as the great divider in this nation. If one of the big three was complicit in spreading the lies of a political candidate like Trump has done to the point that they were able to incite an i**********n well would fine their little asses as they've never been fined before. And now if you are going to say that that wasn't an i**********n then what was Donald Trump trying to accomplish by lying about the e******n? What was his purpose if not to overturn the e******n? He tried every legal means and failed, even with his own judges, why didn't he do as Gore did and simply concede?

That's it. So let the h**e fest begin since I know that the only thing you can do, as a Christian Conservative, is to demean and denigrate those who don't think exactly like you... let's have it and get on with it!!!

We all lived in fear of c*******m, and a nuclear war. There was no such thing as home computers, cell phones, or color tvs. Our first television was a 6 inch black and white, and only had a few channels. It stopped broadcasting around 11: 0 clock. TV antennas topped every house.
There were no mass shootings, or a federal highway system. I remember we all had much less material things, but somehow were happier. After the war, I remember all the cars were black.

99% of people born between 1930 and 1946 (GLOBALLY) are now dead.

If you were born in this time span, your ages range between 77 and 93 years old (a 16-year age span) and you are one of the rare surviving one-percenters.

You are the smallest group of children born since the early 1900's.

You are the last generation, climbing out of the depression, who can remember the winds of war and the impact of a world at war that rattled the structure of our daily lives for years.

You are the last to remember ration books for everything from tea to sugar to shoes. You saved tin foil and poured fried meat fat into cans.

You can remember milk being delivered to your house early in the morning and placed in the "milk box" at the front door. Discipline was enforced by parents and teachers. You are the last generation who spent childhood without television and instead, you “imagined” what you heard on the radio.

With no TV, you spent your childhood "playing outside". There was no city playground for kids. The lack of television in your early years meant that you had little real understanding of what the world was like.

We got “black-and-white” TV in the late 50s that had 3 stations and no remote.

Telephones (if you had one) were one to a house and hung on the wall in the kitchen (who cares about privacy). Computers were called calculators; they were hand-cranked. Typewriters were driven by pounding fingers, throwing the carriage, and changing the ribbon. INTERNET and GOOGLE were words that did not exist.

Newspapers and magazines were written for adults and your dad would give you the comic pages after he read the news. The news was broadcast on your radio in the evening. The radio network gradually expanded from 3 stations to thousands.

New highways would bring jobs and mobility. Most highways were 2 lanes and there were no Motorways. You went downtown to shop. You walked to school.

Your parents were suddenly free from the confines of the depression and the war, and they threw themselves into working hard to make a living for their families.

You weren't neglected, but you weren't today's all-consuming family focus. They were glad you played by yourselves. They were busy discovering the postwar world. You entered a world of overflowing plenty and opportunity; a world where you were welcomed, enjoyed yourselves. You felt secure in your future, although the depression and poverty were deeply remembered.

Polio was still a crippler. Everyone knew someone who had it.

You are the last generation to experience an interlude when there were no threats to our country. World War 2 was over and the cold war, terrorism, g****l w*****g, and perpetual economic insecurity had yet to haunt life. Only your generation can remember a time after WW2 when our world was secure and full of bright promise and plenty. You grew up at the best possible time, a time when the world was getting better.

More than 99% of you are retired now, and you should feel privileged to have "lived in the best of times!" If you have already reached the age of 77 years old, you have outlived 99% of all the other people on this planet. We are a 1% 'er!
