trump is charged because he was given multiple opportunities to return them, but refused. He was asked politely. He was subpoenaed. He turned in a signed affidavit falsely stating all documents were returned. Then complained like a spoiled child when the FBI enforced a search warrant.
Biden wasn't charged because he cooperated.
Maybe rather than believe what comes out of trump's mouth, you should do some research. This is an excerp from the special council's report:

Very important fact, Biden knew he had the classified documents in 2017. That is when he should have notified officials and returned them, did he do that, NO! He waited until late 2022 & early 2023. To honest people that seems to be contributory to a crime. He knew he had them, lets not forget he ALSO had classified documents from when he was a senator. Different justice for different political parties!
