If you check the reference I gave it is based on your best 35 years (140 quarters), the 10 year (40 quarters) requirement is what is needed to QUALIFY for SS. If all you were able to do was pay in for 40 quarters then your "average earnings" would be calculated on those 40 quarters plus 100 quarters of "$0 earnings".

Is it fair if someone has to pay into SS above the cap then not get any credit for paying in the extra amount, or is it just to punish the rich? I don't get any discount on gas, food, clothing, t***sportation, etc. just because I earn a lot less than someone else, do you? If the SS administration was a private company that was repeatably unable to pay out it's contractional obligations the government regulatory agencies would be on them faster than a dog on a fresh ham. Perhaps that might be a good place to start looking for a way to preserve the system.
