I am not a RE Attorney so it's best to consult one. Not sure how far Archie's neighbor would take this over 150 sq ft of land. Not far if he is smart because he will lose in the end. Archie has more to lose up front with the cost of 600 feet of fence if it actually turns into a real legal fight.

I got a 300K judgement against an individual awhile back which started over an individual dumping a couple small pickup trucks of trash on my property. The whole conflict for various reasons cost the other side over 4 million in mostly lost disability income. Though it took many court hearings and 20 years to collect my 300k plus interest. Some people are to stubborn and lack common sense for their own good.

Agreed. He has to consult with a local RE Attorney. The legal system is broken as you know. But if the Town gives him a new deed he has some additional third party government juice so to speak. If the neighbor is stubborn and gets an ambulance chaser (a real Attorney wouldn't take the case from his neighbor if the statute is on Archie's side unless unethical and paid in advance, no contingency, so the neighbor would pay, but a lot of money could be spent for a Summary Judgement on Archie's behalf if that pompous, nasty neighbor does have money. I'm sure Archie will do a cost benefit analysis after speaking to the local Attorney. And congrats for finally winning! And hope they get locked up for fraud for defrauding a fake injury, I am guessing.

Wasn't so much a fake injury as a no longer disabled situation. Somehow the insurance company got videos of him building something on his property next to mine. I can't imagine where that video came from. Lost him 80K/yr in disability insurance payments for the rest of his lifetime.

I've, we've already won this little snit that jackass created. He did the same thing to some friends who purchased the 5 acres to the south of us about 10 years ago. It was unimproved, meaning, no fence, well, septic, or anything. Just 5 acres of grass and yucca.
They had it surveyed then, and the original survey pin is actually a few inches behind my corner post, on New Hampshire's side of the fence. It's a metal rod that was driven into the ground to mark the official survey. This guy is going off of orange painted wooden stakes. Not legit.
On top of that they found out that according to Texas law, if you have livestock, you can't use your neighbors fence to secure them. You have to have your own. When they bought that land, I let them start their fence off of my corner, and, my South fence is the boundary between our land. They rotate horses in, and out of there for the grazing ass the grass grows during the year. They even maintain my South fence. It's a neighborly kind of a thing. No big deal at all.
But, now that a blowhard has interjected himself, it ain't gonna be for him so much.
He borders, and disputes both of our property lines, but we are right according to Texas law. If he so much as turns a goat out there without his own fence between us to keep it in.....not sure, but I do look forward to the battle.
Nobody's seen, or heard from him in a few days, so, maybe he's getting educated himself. I don't know.
One thing I DO know, and the neighbors agree, WE aren't paying for another survey of our properties.

It may be something about being from New Hampshire. There was this guy that called the police on some guys duck hunting, completely legal, below the high tide mark, in the bay by me. Turns out the guy came out screaming and swearing because the day before there was another group of people hunting the same spot. Then this New Hampshire guy called the police.
The officer that showed up was a fellow duck hunter. The cop called the game warden who proceeded to give the New Hampshire guy a fistful of tickets. He bitched at the game warden, the cop , the two guys hunting and me. And I wasn’t even hunting !
Either way, we all know you’re going to have fun with this jerk you’re dealing with.

If you found the one property pin then you can likely find the others with a metal detector. There should be one in each corner of the property.

The surveyors who marked the property my neighbor bought found it on the one corner. No doubt there is one on the other corner. I'm gonna leave it till this guy opens his yap again. I've paid the property taxes on his disputed 3 inches for over 30 years.

Shame huh? Crazy things mysteriously show up, Lol. Patience on one's part can be a valuable virtue. The ones like that always screw up. They are cocky and nothing to back it up. Easier to be honest and have personal integrity.

I am curious. What are this guy's options against you if he tries to pursue this farce ? Does he sue you to get the fence moved ? Does he just scream louder ? What must you defend against ?
