It seems that I have a new neighbor to the West of me. I didn't know it until today. I was outside doing some work when I noticed an orange stake at my back fence, so I went to see what the what. A guy, prolly 200 yards away on the other property is yelling, and waving at me. I waved back, and went about my business.
Long story short, the guy showed up at my front door puffed up like a Banty Rooster, talked smack to my wife (I was out back), and then came to where I was, and came at me with complete attitude because he claims his survey shows that my fence is 3 inches over his property line. He talked funny, so, I asked where he is from, and he said New Hampshire. I tried to be reasonable with him, but, he's DEMANDING that I move a little over 600 feet of fence that's been here for over 40 years.....3 inches.
This guy got so loud, belligerent, and demanding that my wife called the Sheriffs Dept on him because she thought it might get physical. This was a two hour ordeal over 3 inches of fenceline.
Is everyone from that part of the country that way? If so, stay there. Otherwise, you might try to bully someone with less patience than me, and catch a hammer upside the head.

Yeah, unfortunately, my daughter, bless her sweet soul, married one from New Jersey, he is the same way. Constantly griping about little things that mean nothing.

That property back there has been vacant for 20 years. Apparently, this cocky jackass bought it, and is going to build a house there. It's 10 acres bordering my 5 1/2. 3 frigging inches this guy is talking about. I now, have to dig out the survey papers from when I bought this place 33 years ago. That fence was there when I bought the place.
I'm madder about his attitude than the 3 inches. And, now, I'll go full blown Caitlin Jenner before I move that fence!!
Lol!! I LITERALLY had a 3 pound hammer in my hand when that dude stormed around there, and started in on me like some kind of intimidating badass. It was really kind of funny. The accent, the bravado, the balls, all that.
The deputy was pretty patient with him as well, while attempting to explain to him about being trespassed from my property.
I dunno, we'll see how he does. I'm thinking he didn't move into a friendly neighborhood.
This is Texas. We're a little different here. You push, we'll shove.
This could be fun!! 😁

Yep, my daughter also is in Texas, Hockley, right outside Houston, and her husband from Jersey, go figure. She has to calm him down all the time.

I found my original survey, and researched the laws regarding these sort of disputes. I've got this!!
If this fella would not have tried to be a bully, he wouldn't have the problems he's about to.
There has been an illegal dump site on that property for years. The county has been notified.
Let's play.

Good for you. My husband would have probably hit him with the hammer, or shot him with his judge, he is from Waco.

We had to move a fence in Houston, sold home, and they did a survey. We knew it was about 4 inches over, we had an in ground pool put in, and our neighbor said to move the fence, he didn’t care, so we did, then when we sold it, we had to move it back. Wasn’t a lot of fence, just one one side.

Nothing like setting the tone that way with your new neighbor.

OK...the facts: 1) If as stated, the fence has been there for 30 years, you probably legally own the property.
2) 700' x .25' nets 175 sq feet. One acre is 43,560 sq feet. The area in question represents .004 acres. Not knowing the type of real estate so wild guess $10000 per acre, write him a check for $40 or tell him to get a lawyer.

No, not all from the Northeast are that way. People are people no matter where. You just got a bad neighbor. I couldn't imagine starting off acting that way nor demanding a new neighbor move a huge fence 3" That is pretty absurd as far as I am concerned. And how does he know that surveyor was not off by 3". Either way absurd.

If that fence has been there for forty years you have been maintaining the fence and 3" of property on your side of the fence, you now own that 3 inches and have for a long time. Adverse possession. The length of time for adverse possession varies by location. But generally somewhere around 7 to 20 years. If you want to lay claim you should get a survey done to include the 3 inches and file a corrected title. If you want to be neighborly and if he wants the 3 inches back, You could always sell it back to him for the cost of the fence.

Stryker has the best advice if you really want to piss him off. Sounds like Stryker may be a RE Attorney or in that field. Like he said, statutes do vary by location. Would like to see his face if you did refile your title to include those 3" Lol.

Strycker, I've heard it called adamant possession here in Rhode Island, but it is the same thing. If you maintain a piece of property for 20 years, it becomes yours. Having it surveyed and changing the title is a great idea.

A Nation of Laws.

Melonoma2, why is it that "A Nation of Laws" means something different if you are a Democrat. Remember there is right and wrong (leftist), and democrats are almost always wrong. When he purchased the property, the fence was already there. You obviously have a reading comprehension problem.
