Big Difference Between Killing Someone And Intentionally Killing Them...

It's defined as manslaughter, negligent or accidental...and murder meaning that was the intent, there being shades of planned or incidental.

Assaulting someone, punching them, has shades of prosecution. An unprovoked attack on someone minding their own business at the time of being punched or assaulted is profoundly different than being punched in response to being provoked.

A punch that was unprovoked that resulted in the inadvertent death would likely be seen as a murder, the inadvertent death of someone who provoked being punched in the first place could be seen as an accidental and unintended consequence. Within that context of to what degree it was provoked in the first place is part of it as well. Racial slurs on one hand should be seen as a crime in the first place because they can understandably incite and bring on violence.

When a black person is called a (spade) or worse, we are seeing videos that tell the story. When I'm seeing someone blatantly call someone by a racial slur, and that person asks "what did you just call me?", or "tell me I did not hear you call me a (spade)"...and the person doubles down and repeats it in a worse way, they leave no option but to get punched. If they are so frigging racist and mentally retarded that they don't have the sense to back down if not apologize, they deserve to get punched, and then charged with racial crimes on top of that.

Unfortunately the person doing the punching should be charged with assault as well, but people can't go around punching people, it works both ways.

Our dead old man in the donut store had his chances to back it down and stop the insults, and he actually deserved to be punched, the dying was not the intended consequence.

If I understand you, it is okay to be a 20 something to deliberately punch a 77-year-old hard enough to knock him out? All over a word that is offensive. And you further think the manager handled the customer complaint correctly? At 77, there were perhaps medical issues, such as Demetia where the individual says things that may not be PC. further, the old man may have had bone disease, making a knock out punch a death blow. all this considered, why didn't the cook just remake the order and apologize, rather than disrespecting the old man and promoting the incident with the store manager?

Your old man in this case was a bigoted racist that has likely been insulting to blacks all his life, it isn't something that came on in older age or dementia. The shame is that a black kid with a good job has to deal with racist bigoted pieces of crap like this.

That's what manslaughter charges typically are, from an "accidental" death that was not intended. Finding a wife in bed with another man who you kill in a rage can be seen as an unplanned death.

Punching someone who insults you is unlikely to be with an intent to kill.

This is about a 77 YO punched in the face and died as a result. We NEED to stop dealing with present day murders based on real or imagined history. Seeing that the PD had been called, there was no reason, other than premeditated venge, the manager should have gone around the counter to punch an old man.

All of us have worked jobs in our lives where we had to deal with Jackasses yelling and screaming at us unfairly. A shame we didn't know we could kill them.

Right, or wrong, I admire the old guy for saying what he thought eye to eye. He committed no crime, he just hurt the little splib's feelings. The poor, dumb, young negro didn't have the self control to handle the situation in a professional manner because his daddy never taught him to be a man. If he ever saw his daddy. He should do jail time over this. Years of it. But no!
Now he gets to lay around the house for a coupla years smoking weed, playing video games, eating mammy's food, and knowing that he can assault the elderly over words, and get by with it.
