Unconstitutional no but definitely not the norm, this will put the democrats on notice and will force liberals on the bench to put off any retirement.

Possibly so. It was the democrat Senate, however, led by Harry Reid, that changed the rules for confirming a judge. And they did it for strictly party reasons. The republicans are simply continuing the same rules.
