Stand your ground laws are little more than a license to kill someone, whether black or white. There is now a boycott against Florida that will remain in place until they repeal this vile fig-leaf for violent hate crimes.

I'm not a big fan of Hillary Clinton. I will however vote for her over Jeb Bush, who signed this grotesque piece of legislation. I'm sure the Democrats will remind the public of Jeb's role, in this neanderthal legislation, at election time. This is presuming that the upcoming tea party tantrum won't result in Jeb's being denied the nomination.

Its obvious that some folks on the far right, would like to make the U.S. a western version of Afghanistan where every man has his own automatic weapon and grenade launcher. The Europeans, Australians, Canadians, and Japanese continually shake their heads in disbelief when they learn of some new American gun tragedy.

There is one and ONLY one reason to pull a gun on ANYONE. That is when your life or that of someone else is in danger and there is no other escape. You do NOT fire warning shots. Police don't even fire warning shots. There is no telling where that bullet will go. You can fire to wound them, but a LOT of the attackers are on drugs and will NOT feel it. The ONLY time it is permissible to shoot someone is if your life is in danger and you fear for that life or your loved one. Then you shoot to kill and only to kill. Anything else is just STUPID and insane. If you can't shoot to kill, then you have no business carrying a gun. They will take it away from you and use it against you and anyone else that happens to be nearby.

You do NOT pull a gun and wave it around to scare someone, or to even let someone know that you have a gun. You keep it concealed and carry it for defense, NOT show and tell. This is not a game, it is real life and death. If you don't believe that, then don't carry a gun.

Hi Eddie. Delighted. You may or may not choose to believe this, but frankly my dear I don't give a damn. This particular progressive was raised with guns, owns guns, respects guns and understands everything you said. It's the laws silly, its the laws. Since ginnyt (above) explained the rather asinine idiosyncrasies of Florida laws, I now better understand the sentence Giles received, not that I think it is right. If your buddy Vern was aware of those laws and I owe an amends, I hope he accepts it now. That being said, it doesn't seem your comments really deal with the topic? Is the law used equitable for blacks and whites I believe is the topic? My humble opinion is Zimmerman got away with murder part because of the races involved and now I see possibly because his lawyer knew enough to claim "threatened". (Zimmys behavior since he got off seems to be proof he shouldn't be in possession of a firearm.) Had Giles lawyer used the same defense, maybe he would have gotten off as well. Now there is a whole new case of Dunn (white) killing Jordan Davis (black) over loud music. At least "stand your ground" didn't prevail but it makes me wonder if the law is encouraging idiotic behavior? My buddy Old_Gringo (HI Gring! hope you don't take offense me calling you a buddy) says 9 out of 12 blacks freed be SYG Law. No reason to doubt, but would be nice to see more figures, ie who many whites and how many multi racial incidences. My point is what is good for the goose is good for the gander. And I think that was the topic of the conversation. If a law is on the books it should be used the same for all. I personally don't think this country has a problem with guns. I know this country has a problem with idiots that posses guns.

BTW one last point. I don't believe ANY of the above mentioned idiots should have used a firearm. You are right it should be last resort and not show and tell or any other nonsense. Nor should the law be used to cover up any nonsense.

thanks for the post and information.

The law appears to have some apparent flaws.

Bo,

It has been quite some time. I hope that all is well with you and your family.

I am going to weigh in on this because it is a matter of how Florida law is written. The individual, Mr. Giles, said that he fired a "warning shot." In the state of Florida, that was the same as saying that there was no fear for his life. The law in question, is:

aggravated battery with a deadly weapon and sentenced under Florida Statute 775.087 (3):

3. Any person who is convicted of a felony or an attempt to commit a felony listed in sub-subparagraphs (a)1.a.-q., regardless of whether the use of a weapon is an element of the felony, and during the course of the commission of the felony such person discharged a “firearm” or “destructive device” as defined in s. 790.001 and, as the result of the discharge, death or great bodily harm was inflicted upon any person, the convicted person shall be sentenced to a minimum term of imprisonment of not less than 25 years and not more than a term of imprisonment of life in prison."

Due to the law, the young man could not have received any other sentence. Had he been afraid for his life, then it would not have been a "warning" and would have been a shot to stop or kill the aggressor. He should have, being a gun owner, made himself aware of the laws governing self defense. Indeed, his defense attorney did not fight the case as a stand your ground. Perhaps had Mr. Giles not told the investigators that he had fired a warning shot, and his intent was to warn off a potential escalation of a bad situation, then his defense could have been stand your ground. A good thing for everyone to consider, if you pull a gun, then you must be mentally prepared to take the other person's life.

After zimmerman and dunn beat the rap, it seems that the "stand your ground" laws are NOT applied equally.

Why, you ask? Giles is black, zimmie and dunn are white.
Makes one wonder, hmmmmmmm

No wonder there are petitions to commute this injustice.

No wonder scott must be replaced as governor.

Dunn Done got 60 years may he serve each and every year of it. Yep stand you ground is nothing more than a hunting license to some bigoted whites who see the law as being in their favor. Stand your ground laws need to be repealed. Self defense needs to be protected.

Tom this where your total ignorance of a subject has shown itself. You know absolutely NOTHING about what you have just posted. Shame on you for taking what someone, Media?, quite possibly an anti-gun prevaricator, has said and ran with it. I will repeat, you are totally ignorant of what you posted.

Just for clarification, I am not speaking of Dunn. He got what he deserved. By the way, his defense in no way had anything whatsoever to do with the SYG law. It was never brought up, nor alluded to, in his defense.

Mr Ed. With all the noise, I want to say that you are right. Many of the posters who are yelling for blood, for justice for this Airman who was so badly treated, I bet that they did not dig deep into the reports for any information other than what was in the link. Well, if you do take the time. Here is a bit of information that was conveniently missing from the link. The fight broke out, everyone was evacuated from the building. The fight continued to the parking lot. The man (Airman) in question WAS NOT PART OF THE FIGHT. But, He went about 1 block away, retrieved his gun from his vehicle and went back to where the people were fighting (now with a loaded gun) and went into the group of people fighting. A logical person would have to ask, was this premeditation? He had to walk the distance, he did not have to return to the fight, he had a choice of staying at his vehicle and waiting for his friend. He chose to take his loaded weapon back and enter into the scuffle. Seems to me that he went back with intent to shoot someone. Self defense? I do not think so. He had already escaped.

So, under Florida law, if you shoot someone with the first shot, you can go home and sleep.. If you warn the fool by missing him, you go to jail for 20 plus years... Awesome, who would have believed.. wonders never cease... So the stupidity of Florida lawmakers is actually true... Amazing...
