There is a difference between I don't recommend prosecution and nothing there. When the head of the FBI (I don't remember the spelling of his name) testified before congress he is seen on videotape saying 3 or 4 times " she lied" about whether there were classified emails on the unsecured server and how many devices she had. It is also known she destroyed emails after they were requested. Thats obstruction of justice.
