You're right, but it appears to be a gray area. Heck, the legislators are responsible for creating a budget, but they never discuss that either...at best EO's are temporary to get congress to do the things they should be doing. National emergencies do give the President a lot of leeway, which we need. It has resulted in bad things, such as the patriot act.

The U.S. Supreme Court upheld Obama's action, creating the right of the executive branch to legislate from the oval office.

Congress now becomes an unnecessary duplication of effort.

Duplication of agency duties / responsibilities is to be eliminated as wasteful spending / regulation.

The new Supreme court majority affirms this policy.

The Congress of the United States is DISSOLVED.

The two remaining branches of federal government are renamed, DICTATOR & THE RULING JUNTA.

The ruling junta is to be hand picked by the dictator without oversight or recourse.

Agreed~~~besides the garbage we're fed in why we even need the NSA...They do not stop anything, even when known, as you point out....All this duplicity in security and yet it stops nothing World wide...The US, France, Australia, Belgium, the Middle East, etc..When is enough??

What it does do, rather efficiently, is make monitoring the citizens of this country their primary objective, while claiming it all for our security!! Yeahhhhhh righttttttttttt.........
