It has come to our attention while observing your nuclear negotiations with our government that you may not fully understand our constitutional system. Thus, we are writing to bring to your attention two features of our Constitution—the power to make binding international agreements and the different character of federal offices—which you should seriously consider as negotiations progress.

First, under our Constitution, while the president negotiates international agreements, Congress plays the significant role of ratifying them. In the case of a treaty, the Senate must ratify it by a two-thirds v**e. A so-called congressional-executive agreement requires a majority v**e in both the House and the Senate (which, because of procedural rules, effectively means a three-fifths v**e in the Senate). Anything not approved by Congress is a mere executive agreement.

Second, the offices of our Constitution have different characteristics. For example, the president may serve only two 4-year terms, whereas senators may serve an unlimited number of 6-year terms. As applied today, for instance, President Obama will leave office in January 2017, while most of us will remain in office well beyond then—perhaps decades.

What these two constitutional provisions mean is that we will consider any agreement regarding your nuclear-weapons program that is not approved by the Congress as nothing more than an executive agreement between President Obama and Ayatollah Khamenei. The next president could revoke such an executive agreement with the stroke of a pen and future Congresses could modify the terms of the agreement at any time.

We hope this letter enriches your knowledge of our constitutional system and promotes mutual understanding and clarity as nuclear negotiations progress.

Dave, was this or was it not, an attempt to change the course of negotiations? The constitution gives the sole power of negotiations to the executive branch.

You have to be ignorant of the letter, too stupid to understand it, or too filled with h**e, spite, and envy to think clearly if you thought this letter is in the neighborhood of what you've been told by the l*****ts.

If you want a binding treaty, it must be ratified by Congress. Anything less is an Executive agreement and like the letter says can be ripped up by the next POTUS. And most assuredly would be.

Obama couldn't pour piss out of a boot if the instructions were written on the heel.

Did you read it?

It was simple. It made clear the extent to the powers in 2 of the 3 branches of American government. It's not written in secret code. It means what it says.

When the 3 Democrats, prior to America's invasion of Iraq, went to kiss Saddam's ass, it was done in private. When Pelosi went to kiss Bashar al-Assad's ass, it was done in private.

This letter, like the letter from Ted Kennedy letter to the USSR, or the famous 'Dear Comandante' letter to Ortega were all done clearly and openly.

The biggest difference is that the only one Democrats are whining about is the only one that was not trying to negotiate with the enemy.

And ... This is the only such incident where the people of the Congress did not side with the enemy against America.

Please answer a question... Why is it so important to you and the other l*****ts that Iran get a nuclear weapon, anyway?

It sure seems straight forward to me. In no way does it circumvent any part of this fool presidents ability to make a dumb ass agreement.

I think president Obama and the democrats are mad because the letter provides Iran informative actions that this nuclear agreement with president Obama could not be valid and binding without Congressional approval. It also negates about Obama's executive action which could not be enforceable after 2016 because it did not pass through a valid constitutional process with Congress approving.

All these actions had insulted a very naïve and narcissistic behavior of our president. He had made such executive actions a norm of standard on how he executes local and international treaties by his own, bypassing Congress, and thus ignored a constitutional process and guidelines.

What you have is a group of 47 stupid American senators who have to be schooled on their own Constitution by the leader of another country. Too bad they didn't understand what they wrote. You can't make this type s**t up....it's real

Who told you that?

You're a perfect 100% wrong.. It's hard to be that wrong by accident.

47 Senators schooled Iran on the American Constitution..

Read the letter if you don't understand that.

I personally think this letter is the best thing that could have been done as it has brought a lot attention on the fact that our F**E leader has been trying to secretly deal with the Iranians! The letter basically informs the Iranians that any deal they do with JUST our F**E president is not worth the paper it's written on unless it goes through the congress...the F**E sure as hell wasn't letting them know he was & is trying to act like a King not a President.
