The IRS is defending its decision to let i*****l i*******ts claim up to three years’ refunds on income even if they never paid income taxes, telling Congress in a new letter last week that agency lawyers have concluded getting a Social Security number triggers the ability to go back and ask for previous refunds.

President Obama’s new deportation amnesty could grant Social Security numbers to as many as 4 million i*****l i*******ts, making many of them eligible for tax refunds under the Earned Income Tax Credit even for years when they c***ted on their taxes, by working off the books and not filing tax returns.

“Section 32 of the Internal Revenue Code requires an SSN on the return, but a taxpayer claiming the EITC is not required to have an SSN before the close of the year for which the EITC is claimed,” IRS Commissioner John Koskinen wrote in his letter to Sen. Charles E. Grassley on Wednesday.

The IRS’s chief lawyer had reached that conclusion in 2000, and the agency has newly confirmed it, Mr. Koskinen said.

Mr. Grassley called that a mockery of the law and said he will try to write a bill specifically prohibiting it.

“The tax code shouldn’t reward those who broke our i*********n l*ws,” the Iowa Republican and chairman of the Senate Judiciary Committee said in a statement.

The IRS is probably the only Federal Bureacracy that commits more crimes than the BATFE.

Things like this have a tendency to make me angry. It is anger wasted, and hurts no one but me.

It seems to me that if you get a SS card, you can claim taxes for that year. If you have paid taxes you can file for a refund, including amended returns for previous years when you paid taxes. If you did not pay taxes, you do not have a claim, but don't let that stop the outrage from poorly stated editorials.

If they did so, they did it with a f**e social security number. That is a felony. Or it used to be before your God-King decreed it wasn't.

They can claim earned income tax credits from up to 3 years when they had no card. If they paid taxes, they did so with a f**e social security number, which is, or was, a felony.

The following link is a very long read, but includes testimony from Federal Law Enforcement regarding the seriousness of identity theft by wetbacks. These are the felons that the IRS, and the Obama Administration are granting amnesty and earned income tax credits. I am not going to paste this, as it is a long article, but it will open your eyes. Or maybe not.

tdsrnest- As Loki said, they would be claiming the earned income credit based on their low income. Another ill conceived plan by democrats to reward those who have broken our i*********n l*ws at the expense of the hard working citizen who is struggling to feed his/her family. This could cost us several billion dollars. While our citizens are on food stamps, Obama chooses to put their tax dollars in the hands of the i******s in the form of a benefit which they do not deserve. This administration is so screwed up that it cannot be fixed but must be replaced. Good Luck America !!!

Not for wetbacks with stolen social security numbers. I should have known you would not use the link to read the article.

It is hard to believe that there are no checks and balances. I have seen the reports, because I would always ask for a copy when I went to a new employer. Everything was there, college, credit score, military service, old addresses. So the employers use one system for us and another system for i******s. If they could not get hired, there would be no reason to be here.

Wanna bet? I live in an area with a very large illegal population. Less than half are employed, but most have several children, and they receive Food Stamps, welfare and housing subsidies. I am not exaggerating. Wetbacks receive government entitlements at a per capita of more than twice as high as b****s, w****s or legal Hispanics. The IRS is now saying that they can receive earned income tax credits for up to three years, even if they had no social security number. How do they determine how much money these thieves will get? Their say so? Many of them have been "paying taxes?" The only way they can do that is by using a bogus social security number, which is a felony. Use of a bogus, or stolen SoSec number for the purpose of obtaining employment is a felony. The amnesty will ignore that. The Administration last year released more than 36,000 wetback felons from prison "pending their deportation." Would you like to know how many of them showed up? Almost all of them disappeared, except for the ones who promptly got themselves put back in jail for committing still more crimes. This Administration is responsible for destroying our Southern Border. Even more so than the Bush Administration.

Mostly off the subject, but do you remember "Fast and Furious?" It was started and ended under Bush, then re-started by the Obama Administration whose BATFE promptly "lost" more than 2500 firearms. Did you know we found 40 odd that I am aware of? Yep. Confiscated from those wonderful wetback criminals who sneaked them back across the border. I guess they were just returning them, right? I mean, after all, according to amnesty supporters, wetbacks are the most law-abiding people in the world, even though a huge percentage of them are felons. and every single one over the age of 18 is at least a misdemeanant.

The IRS Commissioner affirmed the validity of the title of this thread. As did the IRS's Chief Counsel. You may reread it if you are still in doubt.
