Updating Our Constitution A Bit
Feb 17, 2015 14:24:26   #

Currently, the USA Constitution's Article 1 Section 7 provides for Federal Laws - excluding Amendments - to be passed by Congress & signed by Our President, or being passed by at least two-thirds of each House of the Congress, before becoming Law...

I would like an Amendment that states:

When Congress passes a Law or Amendment, the Supreme Court would review it and declare it to be Constitutional before the Law or Amendment takes the next step in the process...

This will have the guarantee to the USA Citizens that EVERY LAW AND AMENDMENT IS CONSTITUTIONAL AT THE OUTSET...

Excuse me? Have you been paying attention to some of the rulings our SC has been making lately?

If you're right, we might as well have the SC shoot the Law down right upfront & save us all a lot of time & frustration...

I do believe you are dreaming. First of all, most of the people in Congress are lawyers, so they know what the Constitution says. It's not the problem of them not knowing it is unconstitutional, it's a problem of them not caring. They knew the ACA was unconstitutional, that is why they got it passed BEFORE THEY READ IT. Remember that, "You have to pass the bill to find out what is in it" crap?

Also remember WHICH PARTY PASSED IT!

And which party it didn't get a single v**e from. Wh**ever ACA turns out to be, liberals own it, lock, stock and barrel. And they'll still blame Bush when it doesn't deliver on it's promises.

The SCOTUS more often than not rules on their own beliefs and prejudices rather than the Constitutionality of those appeals brought before them.

Theoretically you are right; but in reality, as those who make up the supreme court are hand-picked by the President, their leanings in every issue would pretty much if not completely be in line with the President's.

Your suggestion would have the best chance of working in reality if:
1. All supreme Court justices would be ELECTED by the people, and...
2. All Supreme Court justices had TERM-LIMITS. As an example: 2 term limits of not more than eight years per term.

P.S. Such TERM LIMITS should apply also to all state and federal congressmen.

I do not know if you remember but a few years ago some in Congress proposed that when a new bill was introduced the Constitutional basis for the bill would have to be included. It was shot down by the power brokers in Congress.

Of course it was shot down. Can't let a little thing like the Constitution get in the way of a socialists/c*******t takeover of America.

I don't trust the Supreme court anymore to judge our Constitution.
