Catch and k**l in the tabloid world isn't illegal, and neither is paying hush money to a prostitute or a porn star to keep a secret affair or a one-night stand away from the public -even for a person running for office.
Bragg hasn't identified the statute to any law that Trump is violating which is considered unconstitutional.

It's in Trump's best interest that he doesn't testify because the prosecution would be allowed to ask him any questions regarding his former civil cases (which are being appealed) and lay a perjury trap for him since they really don't have a legal case under Judge Merchan, who himself is defying a NY state law regarding avoiding the appearance of Bias.
