He should be charged next Jan when he is no longer president. Hopefully and rightfully found guilty. Then the Judge should recognize his mental incapacities and sentence him to an appropriate amount of time in total home confinement with no interviews or visitors beyond immediate family. If for nothing else, to define that a law was broken numerous times, without concern to the gravity of the laws being broken, and that there need to be consequences.

One of the problems with charging Biden with a document case is intent. Biden probably never opened the boxes of documents packed up from his public service, so he really didn't know what exactly was in them. So he didn't willfully keep them. When he found out he had classified info, he called, the FBI came and returned stuff he took to the National Archives. End of story. See also Pence case, almost the same.
