While he was president, Donald J. Trump was entitled to possession of all classified American government documents, no matter their secrecy status. He is being charged with illegal possession of quantities of them for an interval of no more than eighteen months.

Joseph R. Biden possessed classified documents from the time he was a senator, when he was never entitled to them. He had them in his possession in a garage secured only by lock and door for a period of at least twelve years. He is not being prosecuted for it.
