If she enters into a court trial without being challenged by Smith, she has power over many things that will never be changed...
...she can allow a jury verdict on charges, but as a judge can hand down sentences of no time served
...she can dismiss the case and there would be no double jeopardy allowed
on ground for recusal, the standard is simply that if Smith can make the case that the public demonstrably would not be able to trust the faith of her ability to be completely non partisan she has to be recused. That is beyond doubt that she has already proved she is purely incapable of acting in an impartial way as a judge...she made the case in her defense when she was overruled that she believes that an ex president needed to be treated with deference and differently than anyone else...end of subject, she is unfit to preside over this case.
