Federal judge strikes down Minnesota law banning 18-20-year-olds from obtaining gun permits

A judge in Minnesota ruled that a state law prohibiting adults under 21 from carrying firearms in public was unconstitutional

A federal judge on Friday struck down a Minnesota law that prohibits adults age 18-20 from obtaining permits to carry handguns in public.

Assisted by gun-rights advocacy groups, three individuals who were under 21 challenged a 2003 state law that enacted an age requirement to apply for a permit to carry a pistol. They argued that the law unconstitutionally prohibited young adults from exercising their Second Amendment right to bear arms.

In a 50-page ruling, U.S. District Court Judge Kathleen Menendez agreed. Relying on the Supreme Court's 2022 decision in New York State Rifle & Pistol Ass'n v. Bruen, the judge concluded that Minnesota's law was unconstitutional and blocked the state from enforcing it.

"Based on a careful review of the record, the court finds that defendants have failed to identify analogous regulations that show a historical tradition in America of depriving 18- to 20-year-olds the right to publicly carry a handgun for self-defense," Menendez wrote. "As a result, the age requirement prohibiting persons between the ages of 18 and 20 from obtaining such a permit to carry violates the Second Amendment."

The logic of the Federal Government. I personally don't think that 18-20 year olds other than military personnel should be allowed to carry in public unless it's deer season or something. You cannot legally purchase a handgun but you can carry one that someone else bought. Brilliant. That being said, I can carry a handgun almost everywhere in the United States but I can only purchase that handgun (from an FFL dealer) in my home state.However, I can make a private purchase almost anywhere. If I am a convicted felon and I lie on my purchase from at the FFL dealer I have just committed a federal felony, but according to the SCOTUS in Haynes v US 1968 I cannot be prosecuted for committing this crime because admitting I am a felon on the form would violate my 5th Amendment rights against self-incrimination. Think I'm kidding? Look up the case.
Kyle Rittenhouse handled himself quite well, but he is an exceptional young man, not an average teen.

I personally don't think 18 year olds should v**e, and I'm kind of ambivalent about them in combat. I was in my early twenties when I enlisted, and half the teenagers in my platoon needed someone to keep an eye on them so they didn't do anything stupid. I mean REALLY stupid. In many, if not most 18-20 year olds, the part of the brain that has to do with rational decision making, the hippocampus and pre-frontal cortex, is not yet fully developed. There is a reason why the age for most of the things you mentioned was originally 21, and that might be a little optmistic.

I understand what you say.

However, these things are applied rather capriciously.

Pick one - and apply it consistently across the board.......

I carried an m40 in Vietnam at the ripe old age of 18. Was married and had a son! Under age, I don't think so. From our last conversation I thought you had a college degree, adults start at 18! Obviously your college is from whatsamatter U!

I am not very concerned Peg.. Minnesota right wing nuts are not so bad, I have golfed with many of them and not one brought a gun to protect against stray and wild golf balls..

As for mass shooting... we have not had one since the Red lake k*****gs years ago.. Or the west side work place, or the clinic in Buffalo, or the k*****g at St Paul Harding HS.. only one shot so should not count. Or the k*****g of the Mpls North High star student and athlete.. only a 10 grader, sould not count.. Or the Mall of America run down and murder in the shops spree... darn this is not going as I planned.. well a few murders are the price of freedom even in our fine state..

As for the law.. I agree that as long a 18 year olds can go to war, they should also be able to own guns as civilians..
But the opposition to that does have some good points.. such a conundrum.. darn, I like to get a solid POV and not waver.. but life goes on..
