The special master, and the appeals court isn't looking at the factually incorrect premises trump's legal team is cooking up that amount to side shows that distract from the fact that they have no legal ground to stand on...they are going back to the facts that Cannon chose to ignore as she allowed nonsense premises to be accepted.
For instance, they say that hand written notes on classified documents would cause them to be protected under executive privilege...go back to the fact that regardless opf classification, or notes, all documents classified or not, there being no executive privilege for an ex president, even his documents that he thinks are protected still belong to the government, the people, he stole them whether they were unclassified or not.
Had the DOJ challenged the special master in it's entirety the appeals court would have gone back to the fact that there was no standing or precedent for a special master, they'd have thrown the whole thing out.
There is no document a special master could find that will go back to trump, there is nothing that is his, given that it is up to archives to decide what he can have after they go through it.
