They probably have known for some time now but will never "out" the person who leaked it or the Justice from whose office it was leaked (IMO, probably kagan and probably with her knowledge and consent). After all, somebody might dox the guilty party and conservatives might protest in front of his/her house (*gasp*). And, of course, we all know how dangerous it is to have protestors hang out in the streets in front of Justices' homes .. and to have would-be assassins drive all the way across the country to carry out a nefarious plot. We couldn't have that, now, could we?

And the reason we know it was not a clerk for a conservative justice is because that information would have been released and would have been front page news weeks ago--probably along with an FBI raid on the home, and arrests made as well.
