Court sides with IRS in tea-party targeting scandal

Bush-appointed judge says 'no harm done'

Lois Lerner directed the IRS during the tea party targeting scandal and famously “lost” her emails.

A federal judge has sided with the Internal Revenue Service and dismissed lawsuits by tea-party groups seeking redress for the secret targeting of their applications for tax-exempt status, which the groups argued were intentionally delayed for political purposes.

The tea party organizations immediately announced they would appeal the decision by Washington, D.C., District Judge Reggie B. Walton, who was appointed by former President George W. Bush.

Walton ruled that two lawsuits by Texas-based True the V**e and Linchpins of Liberty, along with 41 other conservative groups, were moot because the IRS took steps to address the scandal and “publicly suspended its targeting scheme.”

Jay Sekulow, chief counsel of the American Center for Law & Justice, which filed the lawsuit on behalf of the tea party groups, said he plans to appeal the case.

“The decision by the court is disappointing. However, it does not deter our efforts to seek justice for our clients. We are reviewing the decision and plan to appeal,” Sekulow said in an emailed statement.

In its federal lawsuit, the ACLJ represents 41 organizations in 22 states. Of the 41 groups, 28 organizations received tax-exempt status after lengthy delays, seven are still pending, five withdrew applications because of frustration with the IRS process, and one had its file closed by the IRS after refusing to answer the unconstitutional requests for more information, Sekulow said.

“It’s a disappointing ruling because it basically leaves targets of bad behavior by the IRS without a remedy,” Hans von Spakovsky, senior legal fellow at The Heritage Foundation, told The Daily Signal.

Walton decided that because the organizations eventually won tax-exempt status, any wrongdoing they suffered had been remedied.

“We are stunned by today’s judgment,” said Catherine Engelbrecht, founder of True the V**e. “The notion that the IRS can target Americans for years because of their political beliefs is reprehensible.”

Although the tea party groups argued there is no guarantee the IRS would not target conservative groups again, Walton ruled that the “prospect of future harm is speculative.”

Von Spakovsky, the Heritage legal fellow, told the Daily Signal that given the unapologetic behavior of Lois Lerner and other Obama cronies at the IRS, “and their total lack of remorse, I don’t think it’s ‘speculative’ that this could happen again in the future.”

Sekulow said previously that the IRS violated the groups’ constitutional rights to due process and equal protection with its secret targeting of their applications. The lawsuit was initially filed on May 20, 2013, with 25 plaintiffs. But more have come forward.

“The floodgates opened after we filed our initial lawsuit,” Sekulow said after the complaint was amended in June 2013 to reflect the additional groups. “We have been contacted by many additional organizations that have been unlawfully targeted by the IRS — revealing that this unconstitutional scheme was pervasive and damaging.”

a judge appointed by George W. Bush do you really believe what you post, of course you do.

There was no law broken and 28 got their exemption now a bunch of Tea party groups looking to get a big payout of tax payers money
Dollars 5 withdraw that application because they knew they were entitled to tax exemption if all they were going to do was political activities 7 still pending wonder why?

He found the IRS did harras conservatives but refused to hold them or any individual accountable,what a convient ruling.At least I will call out a bad Republican,when was the last time you outed anyone from the Democratic Party that is drowning in a sea of corruption.by the way he did follow script,Obama's,he sure didn't follow the rule or intent of the law.

He basis said stop crying and move on> no one was denied
an exemption. Why do you guys keep calling harassment when they were ask to prove proof that they were truly a 501 tax exempt group(who by the way are not allowed to engage in political activities) and what community programs they were going to preform

what laws has he broken now be specific

"Justice delayed is justice denied." They were prevented from pursuing their agenda during the campaign which contributed to Obama winning a 2nd term. Getting the exemption later may help the 2014/2016 campaigns but it cost the 2012 one. As intended by Barry Baby.

How about the admission from the IRS they did target and delay and then apologized for it with "we're going to take every measure to insure it doesn't happen again", while they to this day continue to do so..This ruling is by A US District Judge IN DC..Does that not surprise you??? Holder and BO at their finest criminality all the way....Allow this empowerment for the already criminal IRS Dept and you allow them to take over period..Right to the SCOTUS it should go....Terrible, unethical sell out ruling by a man who swore an oath to enforce the laws of this land not violate or negate them...

I have written letters to President Obama expressing my thoughts in constructive way but in opposition to his actions. This year, the IRS sent out a letter saying that there was an error on my taxes and I owed them $300. My tax preparer convinced the IRS of their error. Was this a coincidence, I think not! There is serious criminal activity at the IRS and some of them need jail time. We need to elect good solid consurvatives!

Court sides with the IRS who admits they did target the TEA party or other organizations....but due to their ADMITTING it they suspended their targeting scheme and no harm done? WTF is THAT? IRS had NO business being involved in any form or shape of POLITICS PERIOD. Only a pile of S**T would think it is OK for IRS to involve themselves in POLITICS one way or another....what ever Judge allowed this s**t to happen should have their ass beat until dead.
