All defendents are presumed innocent .
But the Patriot Act overrides many of our constitutional rights including right to a trial not just a speedy one. They can be held indefinitely and without charges. The way I read it they can be drug into the street and executed forthwith with no legal repercussions some of the Patriot act expired but that part had to do with wire tapping and gathering electronic information. The NSA went overboard and overreached beyond imagination Every num ber survailed also survailed every number that number had contact with and sometimes all those that had contact those other numbers
Something like 300 numbers generated 15 million numbers being under survailence.
