So if a politician takes an oath to defend the Constitution, and then turns around and tries to take away rights, isn’t that s******n ?
Should they then not be held criminally responsible? And if found guilty, should they not be punished just as the Rosenbergs?

you are logically correct, but in practice the found guilty is the big problem. Therefore, no dice.
