Speaking with Fox News host Sean Hannity, Cruz said the integrity of the e******n depends on the court having nine justices, especially considering the enhanced likelihood of a legally contested contest this year.

“I think it is tremendously important that not only does the nomination happen next week but that the confirmation before E******n Day,” Cruz explained. “Democrats and Joe Biden have made clear, they intend to challenge this e******n, they intend to fight the legitimacy of the e******n. As you know, Hillary Clinton has told Joe Biden ‘under no circumstances should you concede. You should challenge this e******n.'”

“We cannot have E******n Day come and go with a 4-4 court,” Cruz said.

If the seat is not filled prior to E******n Day, America risks a “constitutional crisis,” the Texas senator went on to say.

“A 4-4 court that is equally divided cannot decide anything. And I think we risk a constitutional crisis if we do not have a nine justice Supreme Court, particularly when there’s such a risk of a contested litigation and a contested e******n,” Cruz explained.

“Twenty years ago, I was part of the legal team that litigated Bush v. Gore and went to the Supreme Court. Thirty-seven days the country did not know who the president was going to be, and if we had a 4-4 court it could have d**gged on for weeks and months,” he continued.

“So, I think we have a responsibility — a responsibility to do our job,” Cruz said. “The president should nominate a principled constitutionalist with a proven record, and the Senate is going to take a lot of work to get it done before E******n Day but I think we should do our job and protect the country from the constitutional crisis that could result otherwise.”

Earlier in his interview, Cruz said, “This nomination is why Donald Trump was elected. This confirmation is why the v**ers v**ed for a Republican majority in the Senate.”

White House released an updated list of potential nominees for future Supreme Court vacancies. Cruz’s name is on the list, although he has since stated that he is not interested in serving on the Supreme Court.

Judge Amy Comey Barrett, a conservative justice who was confirmed to the 7th Circuit Court of Appeals in 2017, is thought to be one of the top contenders for the seat.

Senate Majority Leader Mitch McConnell confirmed late Friday that the Senate will v**e on Trump’s nominee before E******n Day.

As Davis pointed out, Ginsburg’s nomination was sent to the Senate by then-President Bill Clinton on June 22, 1993. Trump and McConnell are trying to rush a confirmation because like most in Washington, they know Trump is going to get booted in November. But there may not be enough v**es for McTurtle to confirm anyone.

Everything he says is backwards...he says "everyone knows Biden and the democrats intend to challenge the e******n this year".

Now come on, I think everyone here is smart enough to know that trump has been indicating he will challenge the e******n results, at least if he doesn't win. I guess trump's big spin is that he intends to claim a win even if he doesn't, and hold up counting b****ts that are likely to not favor him.

A lot of Dems have said Biden shouldn't concede.
The Dems sound like they're the ones that know they can't win.
You're not even v****g for Biden for president.

Some in Washington may HOPE that Trump loses, but NO ONE KNOWS unless they have r****d some fraud we are NOT YET aware of!!!

A Constitutional Crisis is PROBABLY just what the Democrats HOPE they can set up to further the DOWNFALL of LAW in this country! This MUST BE AVOIDED at all costs!
