What would happen if Joe Biden dies two weeks before the e******n? Will it be postponed?
There won't be time to remake the b****ts and barely time to pick a new candidate.
If the e******n is postponed does Nancy still become In term pres on Jan 20? Can she write executive orders? Anyone know what the constitution says about this? I'm not picking on Biden but if President Trump dies I know Pence becomes president and then probably Ted Cruz becomes his running mate. But I must have missed school the day this was taught . Any help or thoughts?

25th Amendment. It provides for the t***sition. Basically, if Joe dies, Kamala Khameleon becomes president and nominates a replacement vice-president who must be approved by both the Senate and House.

If Joe passed BEFORE the e******n, does that make Harris the choice of "We the People"?
I'm being lazy and not checking, but that means a P**********l candidate that NOBODY v**ed for...

Where do people come up with such crap? If this were to happen Sen. Kamala Harris becomes the candidate. If the i***t Pumpkinfuhrer choked out on a hamburder and took the long dirt nap Pence would zip up smiling after being the first to unleash a stream on the grave and become the president for the remainder of the term and the Republican candidate. Pelosi has no role in any of it. She would only assume the office if both Pence and Trump checked out.

What is being forgotten is that all of those absentee b****ts for Joe Biden wouldn't count. No, Harris doesn't get them.

The Democrat committee could immediately announce a new candidate for their party. But those cast v**es are cast in stone. No give backs. I can see it now. Trump 45% of the v**e, Sanders 40% of the v**e and Biden 15% of the v**e. And I believe that would mostly reflect in the E*******l College. Another thing. Those states that give all of their E*******l College v**es to the winner of the majority of v**es in the country would have to all v**e for Trump. Funny how the worm would turn.

Another reason to stop this early v****g and mail in v****g nonsense.

What do you mean "what crap"? Do the dems really want Harris to be pres? Or is she just talking points?
Nancy Pelosi is in the mix regardless of the candidate demise scenario. If a clear winner isn't announced by Jan 20th she will be the in term president. Can you say we're fuĀ©<ed?
Maybe it is crap . I m just curious to know the legal ramifications of an unlikely situation.

People v**e for "E*****rs pledged to XXX" If XXX is dead, the e*****rs will be free to v**e as they see fit. Probably the state governments will push them to v**e in a particular way, and since most of these e*****rs are party hacks who do not want to rock the boat they would comply. If the Democrats had the majority, they would probably be afraid of not electing Kamala, and she would be president. Likely they would elect a vice presidint of her choosing. Could be interesting, as she will not be constrained to pick someone acceptable to the v**ers.

But the question as stated was what if he dies BEFORE THE E******N? How can Harris or Pelosi have any standing when Biden has not been elected, and now, of course, cannot be elected? Harris obviously is not the vp, since she has not been elected either. The Constitution as originally ratified, was woefully silent on that issue. When a president dies in office, and there have been several, and the VP becomes president, is it necessary to appoint a VP? Or does the succession continue so if the VP is incapacitated, the Speaker becomes head. The problem with appointing a VP, as I see it, is that there is no e******n - so, as in the case of Ford, he was appointed VP, then became president when Nixon resigned, so though he was president, he was never elected as either VP or Pres. A very strange case, I think. Probably one of the reasons he was not elected to presidency in his own right-policy and the pardon of Nixon, who had not been charged or convicted of anything to be pardoned for----confusing time, and I thought Ford was foolish for doing it. How can you pardon some one who has not been even charged with a crime?
