Let’s Be Clear: Immunization Travel Papers Are Unconstitutional

The American right to freedom of movement was included in the Articles of Confederation, predating the Constitution. Americans in the US colonies would not be required to “show their papers” if they wanted to cross from North Carolina into Virginia.

This freedom of movement principle was so obvious to everyone that the Founding Fathers didn’t even bother to include it in the Bill of Rights. It’s too bad that Thomas Jefferson and John Adams didn’t have a super-genius like Dr. Anthony F***i around to tell them how dumb they were!

Vice President Mike Pence banned the members of his c****av***s task force from talking to CNN and MSNBC, and that’s a good thing. Unfortunately, Dr. Anthony F***i is still running over to CNN regularly to spout his insane (and usually inaccurate) ideas. CNN is loving it!

On one of his latest appearances, one of the Democrat Party operative hosts asked F***i if Americans should be required to carry a C****-** “immunity card” before they can leave their houses or travel from point A to point B. F***i thought that idea sounded just peachy.

“It’s one of those things we talk about when we want to make sure that we know who the vulnerable people are and not,” said F***i.

Who’s this “we” that is talking about restricting the movement of Americans unless they show their papers to the authorities?

No, seriously. I want their names. The American people deserve to know the names of every federal official who is “talking about” the idea of preventing kids from going off to college, couples from honeymooning in Vegas, grandparents from visiting their grandchildren in Pennsylvania and so on, unless they get an official Mother-May-I card from the government.

“This is something that’s being discussed,” F***i continued. “I think it might actually have some merit, under certain circumstances.”

No.

And again, no.


It is not a thing that has any merit under any circumstances. This would be no different than abolishing the First Amendment, Second Amendment, or pick any amendment unless you first obtain a government license. Freedom of movement is a fundamental right that is so obvious that it wasn’t even included in the Bill of Rights.

So again… NO!

Here’s an example of how venerated the freedom of movement actually is, according to the US Supreme Court:

Suppose that a person lives in State A, but wishes to move to State B. That person is on welfare in State A. If that person moves to State B, that state has to immediately begin paying welfare payments to them. State B cannot put a one-month, six-month or one-year residency requirement on that individual before it begins paying welfare to them. That’s according to the Supreme Court in Shapiro v. Thompson in 1969. The reason behind the ruling is that it places an undue restriction on that individual’s right to freedom of movement.

I know that sounds a bit crazy to all of us normal people, but that is how the law actually works and is interpreted. It’s kind of like free speech. You may not like what a person is saying, but their right to say it supersedes your nonexistent right to never be offended.

Placing any sort of restriction on an American’s right to travel from one place in the US to another is blatantly unconstitutional – even though there’s nothing in the Constitution or the Bill of Rights that says Congress cannot infringe your right to freedom of movement.

Any police officer anywhere in the nation can demand you identify yourself. If you are in a car not driving and refuse to identify yourself to the police during a traffic stop you can and likely will be arrested. There is a national state of emergency declared by your illustrious Pumpkinfuhrer this allows restrictions of movement including curfews and restriction of movement the same as would happen after a big natural disaster. In your post you state correctly “ there’s nothing in the Constitution or the Bill of Rights that says Congress cannot infringe your right to freedom of movement.” Couldn’t the state or federal government simply close the interstate and state highways? Or shut down airports legally? Today the death toll from the p******c passed ten times as many Americans k**led as the 9-11 attacks, and look what that did to our civil liberties. Biometric and Face ID combined with invasive searches and secret no fly lists imposed to simply fly on an airplane. As far as suggesting an antibody or immunization requirement is the same as a “Jew or Black card” is ridiculous, immunization when and if it is developed will be available to everyone regardless of race color or creed.

I am not opposed to some sort of a card that states you are either immune due to having had C****a v***s or proven not to have the v***s. We could allow those individuals free rein, and test them once a week. Hey, I really don't want a case of c****a v***s. I would like to restsrt the countty, 5oo

You are wrong, bro. Police must have a reason to demand your ID. You must at least be suspected of commission of a crime. Even after 9/11 ID papers were not required. HS agents were instructed NOT to stereo type international travelers at airports. ID cards rely on testing which requires kits and a couple of weeks to obtain results. Being restricted in the meantime is an over reach of government.

It may be an over reach but it is clearly constitutional. You are under the false opinion that you have more rights than reality suggests. Like it or not you live in a quasi police state and have for a long time, it is just now that it is starting to effect middle class white folks that you are starting to give a damn. The time to care was decades ago, it is likely too late. And of course papers were required after 9-11 you couldn’t get into Lower Manhattan without them, travel was hugely restricted and remains so.

My poor wallet is already so full of so many necessary cards that it bulges all out of shape. Please don't ask me to try to carry more, I will be needing to use a backpack just to have room for them.

Ok by your claim if I am sitting in a car that I am not driving, perhaps the car is parked at the curb, for instance a cop can just come over an take me out of the car and frisk me for no reason and with no explanation.
Prove that !! please document hat a police officer can , without cause demand that anyone step out of the car and be frisked for no reason. Sounds like you believe the country is the town of DESPERATION in a Steven King novel.

You will notice on this forum its only Democrats that are wanting to give up their freedoms? It's weird. Msmbc and cnn I think must use subliminal brainwashing of some kind for people to be so ready to give up our constitution

What police state are you referring to? Police departments are far more regulated than ever before, but of course events still happen. Take videoing an arrest scene for instance. Some police will arrest you and take your cell phone for recording them making an arrest . You can sue the pants off of that department for an illegal arrest, search and seizure, but at the arrest scene, you'll spend the night in jail.
We had an officer right here in my hometown that was fired...oh....6 months ago or so...for beating the crap out some arrestees. That ex-officer should NEVER be allowed to be in a position of authority EVER again, anywhere.
A cop can ask to see ID, and as a law abiding citizen, I have NO problem showing them mine. But that is a May I?... not a You must!
Lower Manhattan was the scene of a terrorist attack with over 3,000 casualties...that makes that situation a little different, don't you think? Even then, we could travel freely except at ground zero and by air.
Please, explain the police state you are referring to.

That's why they don't let drunks drive or injured people same reason. Because without you're violating a whole lot of other peoples rights as well.

Drunks have their license suspended or revoked, but they can still freely travel. There are no restrictions on an injured person driving unless they have an accident that was directly due to the injury, and then they assume responsibility.
If you've committed a crime and are not allowed to cross state lines, you gave up SOME of you rights by choosing to commit the crime. The only job I ever had that I had to have papers for is the one I have now. A security officer has to be trained in order to obtain a license. To be armed means more training, shooting at the range, tests, and accuracy at the range to get that armed license, and I have both. A semi driver has to have CDL that shows they are capable of handling a big rig. Licenses are different than 'papers'.

The American right to freedom of movement was included in the Articles of Confederation, predating the Constitution. Americans in the US colonies would not be required to “show their papers” if they wanted to cross from North Carolina into Virginia.

This freedom of movement principle was so obvious to everyone that the Founding Fathers didn’t even bother to include it in the Bill of Rights. It’s too bad that Thomas Jefferson and John Adams didn’t have a super-genius like Dr. Anthony F***i around to tell them how dumb they were!

Vice President Mike Pence banned the members of his c****av***s task force from talking to CNN and MSNBC, and that’s a good thing. Unfortunately, Dr. Anthony F***i is still running over to CNN regularly to spout his insane (and usually inaccurate) ideas. CNN is loving it!

On one of his latest appearances, one of the Democrat Party operative hosts asked F***i if Americans should be required to carry a C****-** “immunity card” before they can leave their houses or travel from point A to point B. F***i thought that idea sounded just peachy.

“It’s one of those things we talk about when we want to make sure that we know who the vulnerable people are and not,” said F***i.

Who’s this “we” that is talking about restricting the movement of Americans unless they show their papers to the authorities?

No, seriously. I want their names. The American people deserve to know the names of every federal official who is “talking about” the idea of preventing kids from going off to college, couples from honeymooning in Vegas, grandparents from visiting their grandchildren in Pennsylvania and so on, unless they get an official Mother-May-I card from the government.

“This is something that’s being discussed,” F***i continued. “I think it might actually have some merit, under certain circumstances.”

No.

And again, no.


It is not a thing that has any merit under any circumstances. This would be no different than abolishing the First Amendment, Second Amendment, or pick any amendment unless you first obtain a government license. Freedom of movement is a fundamental right that is so obvious that it wasn’t even included in the Bill of Rights.

So again… NO!

Here’s an example of how venerated the freedom of movement actually is, according to the US Supreme Court:

Suppose that a person lives in State A, but wishes to move to State B. That person is on welfare in State A. If that person moves to State B, that state has to immediately begin paying welfare payments to them. State B cannot put a one-month, six-month or one-year residency requirement on that individual before it begins paying welfare to them. That’s according to the Supreme Court in Shapiro v. Thompson in 1969. The reason behind the ruling is that it places an undue restriction on that individual’s right to freedom of movement.

I know that sounds a bit crazy to all of us normal people, but that is how the law actually works and is interpreted. It’s kind of like free speech. You may not like what a person is saying, but their right to say it supersedes your nonexistent right to never be offended.

Placing any sort of restriction on an American’s right to travel from one place in the US to another is blatantly unconstitutional – even though there’s nothing in the Constitution or the Bill of Rights that says Congress cannot infringe your right to freedom of movement.

You know who required citizens to carry around papers to prove that they should be allowed to move around?

N**is. And c*******t Soviets.

“Your papers, please!” is almost a cliché and it used to be sort of funny whenever we would see it in a movie about N**i Germany or the Cold War Soviets. It is an utterly ridiculous concept to us as Americans, because we have a constitutional right to move about within our own country without having a special license from the government. (I know, I know, all the libertarians started whining about driver licenses when I said that. Just go smoke some more weed and give it some more thought, guys.)

A C****-** immunization card for travel is no different than a Jew Card or a Black Card or a Mexican Card or an Asian Card in terms of constitutional law. That’s why we shouldn’t be tinkering with our constitutional rights during a temporary medical panic.
