POMPEO, PERDUE LOOSEN REQUIREMENTS FOR H-2 WORKERS

Secretary of State Mike Pompeo, in close coordination with Agriculture Secretary Sonny Perdue, announced last night that the State Department is easing the process for H-2 foreign workers looking to enter the U.S. for agricultural or food processing work.

Last week, the State Department announced that it was suspending routine visa services at all U.S. Embassies and Consulates, including in-person interviews -- a requirement for many H-2 visa applicants. However, under the new directive, consular officers can waive in-person interviews to help continue and speed the processing of H-2 visa applications in cases where the applicant would otherwise qualify for the visa.

Consular officers can, if they so choose, now waive the visa interview requirement for first-time and returning H-2 applicants who have no apparent ineligibility or potential ineligibility.

This expansion also increases the period in which returning workers may qualify for an interview waiver.

Applicants whose previous visas expired in the last 48 months, and who did not require a waiver of ineligibility the last time they applied, do not need to be interviewed in-person if they are applying for the same visa classification as their previous visa.

WHAT ABOUT AMERICAN WORKERS?

The Labor Department reported yesterday that nearly 3.3 million Americans filed for unemployment this week -- the largest number ever recorded during a single week.

And today, the House of Representatives will pass, and send to Pres. Trump's desk, legislation that expands unemployment benefits for American workers to help offset the economic impacts of the ongoing global health crisis.

It seems that it would make more sense for Secs. Pompeo and Perdue, and Acting DHS Secretary Chad Wolf, to encourage farmers and the food processing industries to recruit from the pool of newly, unemployed American workers, rather than make it even easier for those industries to hire foreign workers.

Furthermore, even Politico noted in its coverage that many H-2 workers come from countries that aren't taking the p******c as seriously as they should. Unless the new H-2 workers are tested before they enter the country, this new directive will increase the risk of infection for millions of Americans.

DESPITE AGGRESSIVE PUSH, CONGRESS MOSTLY AVOIDS IMMIGRATION IN STIMULUS BILL

The Senate passed a massive, $2 trillion emergency stimulus bill on Wednesday, and the House will pass it earlier today.

With the bill's passage, we avoided some horrible immigration provisions that were on the negotiating table.

What isn't in the bill:

There was a push in the Senate to increase the number of EB-5 investor green cards from 10,000 to 75,000 each year, while also cutting the minimum investment requirement from $900,000 to $450,000.

The House's counteroffer to the Senate bill included a provision that would have required automatic renewal of visas for any visa holder whose visa expired 30 days before enactment or would expire within the next year.

The House bill would have also required the Trump Administration to reinstate Byrne JAG law enforcement funding to sanctuary cities.

Lastly, the House bill would have required DHS to maintain asylum processing in a timely manner, regardless of the health risks to Border Patrol agents.

The bill does include a provision that sets aside $350 million for migration and refugee assistance. The extra funding can only be used by the agency to "prevent, prepare for, and respond to c****av***s" and can't be used for the resettling of additional refugees.

It also provides funding for local law enforcement to "prevent, prepare for, and respond to c****av***s." The bill prohibits these funds from being withheld from sanctuary cities.
