DECLARATION OF A NATIONAL EMERGENCY WITH RESPECT TO THE 2009 H1N1 INFLUENZA P******C

A PROCLAMATION
On April 26, 2009, the Secretary of Health and Human Services (the "Secretary") first declared a public health emergency under section 319 of the Public Health Service Act,42 U.S.C. 247d, in response to the 2009 H1N1 influenza v***s. The Secretary has renewed that declaration twice, on July 24,2009, and October 1, 2009. In addition, by rapidly identifying the v***s, implementing public health measures, providing guidance for health professionals and the general public, and developing an effective v*****e, we have taken proactive steps to reduce the impact of the p******c and protect the health of our citizens. As a Nation, we have prepared at all levels of government, and as individuals and communities, taking unprecedented steps to counter the emerging p******c. Nevertheless, the 2009 H1N1 p******c continues to evolve. The rates of illness continue to rise rapidly within many communities across the Nation, and the potential exists for the p******c to overburden health care resources in some localities.Thus, in recognition of the continuing progression of the p******c, and in further pr********n as a Nation, we are taking additional steps to facilitate our response.

NOW, THEREFORE, I, BARACK OBAMA, President of the United States of America, by virtue of the authority vested in me by the Constitution and the laws of the United States,including sections 201 and 301 of the National Emergencies Act (50 U.S.C. 1601 et seq.) and consistent with section 1135 of the Social Security Act (SSA), as amended (42 U.S.C. 1320b-5), do hereby find and proclaim that, given that the rapid increase in illness across the Nation may overburden health care resources and that the temporary waiver of certain standard Federal requirements may be warranted in order to enable U.S. health care facilities to implement emergency operations plans, the 2009 H1N1 influenza p******c in the United States constitutes a national emergency. Accordingly, I hereby declare that the Secretary may exercise the authority under section 1135 of the SSA to temporarily waive or modify certain requirements of the Medicare, Medicaid, and State Children's Health Insurance programs and of the Health Insurance Portability and Accountability Act Privacy Rule throughout the duration of the public health emergency declared in response to the 2009 H1N1 influenza p******c. In exercising this authority, the Secretary shall provide certification and advance written notice to the Congress as required by section 1135(d) of the SSA (42 U.S.C. 1320b-5(d)).

How much sooner should he have reacted? China reported their patient zero on 21 Jan 2020. "Today (Friday, Jan. 31, 2020), President Trump declared that the novel c****av***s presents a public health emergency in the United States. Also yesterday, under the guidance of the CDC, the White House C****av***s Task Force announced a 14-day quarantine for Americans who recently visited W***n, China, the epicenter of the c****av***s outbreak. This will begin at 5pm ET tomorrow (Sunday). The 195 evacuated Americans (including a group of U.S. government workers and private citizens) will remain at a military base in Southern California until mid-February.

The U.S. government has not issued a quarantine like this in over 50 years.

On Thursday, the W.H.O. declared that the c****av***s is a “Public Health Emergency of International Concern” (PHEIC)."

Meanwhile the CDC was recommending that elderly people not fly, which the president took out of their recommendations, there being an ongoing conflict between homeland security and airlines over unconstitutional questions the white house wants that the airlines are refusing to comply with. The white house sees the c****av***s as an excuse to force them to comply with invasively unconstitutional questions that have nothing to to with the v***s and exposure such as email information. The airlines does not want recommendations not to fly.

NATIONAL EMERGENCY declared and signed by obama on OCTOBER 24, 2009, AFTER over 1,000 deaths, including 100 children and widespread flu activity reported in 46 states.

Public health emergency declared by HHS Secretary in April.

Neither involved quarantines, screening or banning foreign nationals from the affected region, which is what President Trump did in mid-January. All obama did was what dems usually do--ask Congress for money.

And, while WHO declared the c****av***s to be a "public emergency of international concern" on January 30, it has not declared the v***s to be a p******c even at this time.

Also note that, in the case of H1N1, once the v*****e was available, there were serious problems and delays in getting the v*****e out to enough people due to unforeseen problems .... just like there have been unforeseen problems creating delays in getting enough test kits out for C****-**. It happens. But bo gets a pass from the lapdog media and President Trump does not.

And also note that President Trump had discussions with the CDC about this W***n outbreak as early as the end of December because there were concerns. They were already monitoring the situation at that time and through early January, starting to screen people arriving from the W***n area in mid-January, and finally posting the travel ban for foreign nationals at the end of January. All this and still no p******c declared.

And where was our lapdog press? Oh, yeah, they were over at the Capital Building nipping at the heels of shifty and fat nadler and any other democrat who could give them yet another Trump-hating comment to air on the sham impeachment hearings. The lapdog press, and dems in Congress who continue to slam President Trump over the C****-** response were paying absolutely no attention whatsoever to this because they were sure they were going to take Trump down with impeachment. Now that that didn't work, they've turned their attention to weaponizing the reaction to the c****av***s by fomenting fear and attempting to create as much chaos as possible. All the while doing harm to both our people and our economy .. intentionally attempting to make the situation far worse for their own benefit.

President Trump's response has been swift and as effective as possible. He did not sneak over to China and unleash this thing, nor did he leave our borders wide open for anybody carrying the v***s to walk in and infect us. China is at fault for letting this get out of control initially and for not being forthcoming with information about the v***s that would allow the rest of the world to act more quickly. That is the core of the problem. President Trump is doing everything he can. The dems need to STHU, step up to the plate and try to assist in any way they can instead of badmouthing this administration and playing politics.
