US 9th Circuit rules First Amendment does not apply to YouTube and other online forums

US 9th Circuit rules First Amendment does not apply to YouTube and other online forums, but we must remember that court is full of C****es.

Big quote: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." — First Amendment, US Constitution

It is a common misconception that the First Amendment of the US Constitution protects citizen’s right to say anything thing they want anywhere they want. However, its purpose and language are to prevent the government from restricting speech. The First Amendment does not apply to private businesses such as restaurants and banks or online platforms like YouTube.

The 9th US Circuit Court of Appeals has once again upheld a decision by lower courts to dismiss a lawsuit brought by Prager University against Google. According to the ruling, internet platforms are not subject to the First Amendment.

Conservative talk show host Dennis Prager, who runs the nonprofit PragerU, claimed that YouTube set a large number of his videos ranging from a******n to gun rights as “restricted” and demonetized them. He asserted that this was a violation of his freedom of speech. The courts disagreed.

In a unanimous 3-0 decision, the 9th Circuit said that despite YouTube’s “ubiquity” and its public accessibility, it is not a “state actor.”

So, it seems anyone of us can set up a internet site and post anything we want, vulgarity, sex stuff, and god know's what!

Thanks to President Trump, even the 9th Circuit Court of Appeals is on the road to redemption.

Huh, but the government can penalize entities for mentioning a******n. I guess the 1st amendment doesn't apply to the government either.

They made the right decision. Do you think the administrators on this forum are infringing on your first amendment rights by enforcing rules against profanity and name-calling? Both this forum and YouTube are PRIVATELY OWNED entities and the owners can enforce any restrictions they want. The constitution is about limiting the powers of our government, not private institutions or individuals.

So, then the speed limits on our roads only apply to government cars, lol. The fact is the left-wing now has put a big dent in the 1st amendment and few can see it.

If there was a line in the constitution stating that the government shall make no laws regarding speed limits, then what you said about them would be true, but there is no such restriction in the constitution.

The l*****ts HAVE put a big dent in the 1st amendment, but with 'h**e speech' laws, not this ruling.

Imagine this scenario: Let's say Barack Obama and his B*M admirers decide their war on cops hasn't resulted in enough cop murders yet, so Barack decides to fund professionally-made videos instructing his dev**ees in the art of making, placing and detonating IED's in order to k**l and maim more cops, first responders and other 'deplorables'. He then uploads these instructional videos to YouTube.

According to you, YouTube cannot and should not be allowed to take those videos down because that would infringe on Barack's 1st amendment rights.

You don't get it. I don't own YouTube so I don't have the right or ability to bar or allow anything on it. That is up to YouTube's owners, as it should be.

Don't get me wrong, I'm no fan of Google and I h**e their politics, but I understand that property rights extend to everybody, whether I like their viewpoints or not.

Dennis Prager posted many articles on Youtube, all about being a good person, God, the downside of socialism and many others. All were blocked by youtube, I have to wonder what is youtube agenda for America.
You can say you think it's there right, but I see as it defeats there work of indoctrinating America.

First: I just checked, went to YouTube and typed 'PragerU' in the search bar. The first link led to their page, which contains hundreds of videos. My understanding is that YouTube demonetized SOME of their vids and placed SOME in 'restricted mode', which means about 2% of viewers won't be able to view them. All this is to say/show that your statement, "All were blocked by youtube" is incorrect. Very incorrect.

Second: - This website is private property. Administration reserves the right to disable any user account at our own discretion without prior notice at any time and for any reason. While this is usually a measure of the last resort, we disclaim any and all responsibility for your inability to use this website due to disabled account.

The above is one of the rules for this site, OPP. Does that mean the administration is violating your 1st amendment rights, as well as mine and every other member's?
