Appeals Court Allows Trump Admin to Withhold Grants From Sanctuary Cities


A federal appeals court has allowed the Trump administration to withhold grant money from sanctuary cities.

According to The Hill:

A federal appeals court on Wednesday ruled that the Department of Justice (DOJ) could withhold funding from cities and states that refuse to cooperate with the Trump administration's crackdown on undocumented immigrants.

A three-judge panel on the 2nd Circuit Court of Appeals unanimously overturned a district court judge's ruling that the department lacked the authority to impose immigration-related conditions on certain funding.

The panel’s opinion, written by Judge Reena Raggi, found that Congress had delegated authority to the attorney general to set conditions on the federal grant program it had created, called the Edward Byrne Memorial Justice Assistance Grant Program.

“Repeatedly and throughout its pronouncement of Byrne Program statutory requirements, Congress makes clear that a grant applicant demonstrates qualification by satisfying statutory requirements in such form and according to such rules as the Attorney General establishes,” wrote Raggi, who was appointed to the court by George W. Bush. “This confers considerable authority on the Attorney General.”

The states who sued the federal government over this policy were New York, Connecticut, New Jersey, Rhode Island, Washington, Massachusetts, and Virginia.

I think these sorts of rulings are inevitable and correct. Congress has, in the course of my life time, ceded much of it's authority to the Executive Branch. Makes one wonder how they'll ever get it back.

But there will come a time, probably when the next Democrat is elected President, when Republicans will remember that an unfettered Executive is not what the founders had in mind.

Whether there is any good news coming out of our national politics is highly debatable. One doesn't have to choose a side to know that where we are stinks.

In this case stiff I don’t believe this is a subject (Sanctuary Cities) that is really a congressional decision. I believe the legitimacy of Sanctuary Cities is a function of the Law. Cities just can’t wave the Law. If you want the law changed that needs done in the Legislative Branch and either signed or vetoed by the Executive Branch. Let’s say a city decided to become a Sanctuary city for fully automatic weapons Now I might say great but that action violates current Federal Law so whoever is President could cut funding to that city.

Agreed. As things stand now the ruling is correct, though in reality I have only a layman's understanding of the laws involved.

Basically these cities are harboring fugitives. It is illegal to be in the. U.S. undocumented. I think the entire premise of sanctuary cities is ridiculous. Law enforcement has no problem handing off a citizen criminal who has broken Federal Laws to the Feds. Yet, they will not handover criminal i*****l a***ns. Just stupid pandering to the Latino community.

Agreed! ICE just picked up 3 i*****l a***n criminals who were making appearances at our county courthouse here in northern Cali. You wouldn't believe the outrage that hit the local newspaper the next day. How dare they!!!!
Everyone from the DA, to the Public Defenders, to the private defense lawyers, and even the judges were all appalled!
True to form, a protest group materialized 2 days later, and is now demonstrating outside the courthouse every day protesting ICE for simply enforcing the law. WTF?!?!?!

I wholeheartedly agree with your statement here. He is sliding down a very slippery slope from which there is NO coming back from. Once the operating standard has been established during this administration, EVERY president from here on out will perform the exact same way-----eliminating the separations of power in our government.
