Devin Nunes and the tale of The Scorpion and the Frog

"Phone logs subpoenaed from Verizon and AT&T put a spotlight on the powerful tools at lawmakers' disposal as they seek to investigate President Trump in the impeachment inquiry." ..... https://www.washingtonpost.com/news/powerpost/paloma/the-technology-202/2019/12/06/the-technology-202-phone-records-from-at-t-and-verizon-obtained-in-impeachment-inquiry-spark-controversy/5de93d5188e0fa652bbbdc1e/

"Republican lawmakers are blasting Democrats' decision to publish the records of Nunes's calls, as well as call records from John Solomon, a conservative columnist formerly at The Hill. Nunes said in a Fox News interview the inclusion of the phone records in the impeachment report is an infraction of his "civil rights" and promised to explore "wh**ever legal remedies I have."

While I both like and admire Devin Nunes, I would like to point out that "Two years ago, Congress reauthorized the FISA court for another 5 years, and one of the key sponsors of that bill was Congressman Devin Nunes."

This is the same FISA court that "According to the Justice Department’s own disclosures, for example, the FISA courts only rejected ONE wiretap application out of more than 1,000 that were submitted last year.

In other words, FISA courts approved more than 99.9% of wiretap requests. So forgive me if I’m a bit skeptical about this system of ‘checks and balances’".

So, in other words, Mr. Nunes is complaining that "the inclusion of the phone records in the impeachment report is an infraction of his "civil rights" and promised to explore "wh**ever legal remedies I have."

"The even more ironic part of this story is that Nunes plans on suing AT&T, Verizon, and House Democrats for turning over his call records to Congressional investigators.

I’d love to see that argument in court. “Your honor, I am the person who championed the surveillance on Americans’ metadata… but it’s not fair that my own law can be used against me.”

Sorry Devin. These records and investigatory powers have been used exactly as intended. It’s just that you’re now on the receiving end."

Which brings us to the conclusion of this post. Recall the fable of the Scorpion and the Frog. "The Scorpion and the Frog is an animal fable illustrating the point that people will always revert to their base instincts."

"Congress created FISA in the late 1970s to protect against previous FBI wiretap abuses. Clearly it hasn’t worked, and more bureaucratic hurdles won’t stop FBI officials who lie or alter email evidence. Injecting judges into secret executive-branch national security decisions was always a mistake, and now we know it abets abuse more than prevents it."

When you give power to the government to spy on it's citizens, do not be surprised when that power is turned against you, and should never have been given in the first place. After all that is the nature of power and those in government that will always seek to abuse it.

Get rid of the FISA court. Only recently have I heard of one judge being mad the others crickets. And for how many years? Almost 4? That court is like a lap dog a pit bull who had its teeth removed. I'm sure they LOVED the Patriot Act.
