Following the Janus decision on Wednesday, Justice Anthony Kennedy announced he is retiring from the Supreme Court. Liberal progressives’ heads proceeded to explode throughout the U.S. Every TV and radio station had a Democrat Senator or consultant hyperventilating at the thought of President Trump getting to appoint another Justice to the Supreme Court. Maybe if the government wasn’t so involved in every person’s life, the fate of the Supreme Court wouldn’t be such a big deal?

The question to ask is why is the Supreme Court (SCOTUS) so important? The court is one of the three branches of government designed to check the other two institutions, the Presidency and Congress. As the highest court in the land, it is up to SCOTUS to ensure the other two branches of government do not violate the law of the land, the Constitution. Seems simple enough, but the more government interferes in the lives of people, the more there is for the Supreme Court to rule on.

What has happened to the court has put it in direct conflict with its mission. For decades, the court has made policy and wrote laws. Those are two areas the court is specifically not supposed to be involved in. The job of the court is to look at a law Congress passed, or policy being implemented by the Executive Branch and decided if it violates the Constitution in cases where there is merit.

Many of those complaining SCOTUS has too much power and they are right, but the court has the power it does because government has infected the lives of everyone in the U.S. Progressives have decided if they cannot win at the b****t box or the ideas cannot convince legislators, they will take it to the courts. The very people screaming about Trump taking away democracy are same people wanting nine unelected judges to rule on every aspect of life in the U.S.

Some of the more recent cases in front of the Supreme Court show just how powerful the government has become.

Yes! The courts should not make law. However, I seem to remember an obscure text where there were legal situations when any step the court took meant that it had made law. I cannot find the reference, but perhaps there is a legal scholar in OPP that can explain it.

Supreme Court job is to interpret our Constitution as originally intended and is... not the way SC Judges prefer it sould be or want it to be..."law of the land" previous decrees unconstitutional to the core!

SCOTUS is important for the same reason we insist on having partisan courts, each party wants to rewrite the Constitution and get away with it. Why go through the laborious and risky process of amending the Constitution, when you can just write wh**ever law suits you and have a pet court put it's stamp of approval on it? That way, your rule becomes law....................until the character of the court swings back again.

FDR tried to pack the courts with his sycophants, but the Congress stopped him......................Republicans were outraged by the attempted end run. See how things change given enough time? Now, Republicans are besides themselves with glee and heartily approve of Trump's attempts to....................pack the courts.

One hard fact can be derived from studying American history................................eventually, things swing back the other way. Eventually we'll have another Democratic President, who will spend his/her first 100 days undoing everything the previous GOP President did, the another GOP President will spend his/her first 100 days undoing what the previous Democrat did, then another...........................

Tell me; how are we to make any significant and lasting progress towards making average Americans lives better, when we insist on using partisan bats to beat the Constitution back and forth between two ignorant parties?

In theory that is suppose to be the case. The constitution must prevail. But now, who ever is the party in power gets the upper hand regardless of the law and the constitution.

Our government has gone too political. E.g. The democrat party in order to run their agenda according to their own terms, they choose SC Justice who lean to liberal policies. And the Republican when they are in power appoint the more conservative Justice. Right now, the most important is the party who sits at the WH, and who dominates Congress. When majority in Congress are democrats, and majority in the senate are democrats, their nominee wins. Likewise to the republicans.

If those in Congress focus on the constitution, there would be no problem in choosing the SC Justices who are constitutionalist. I think president Trump did it right when he selected those who will rule via the constitution.

During the reign of Mr. Obama, he run like a dictator via "Political Correctness" by-passing the constitution.

The key to America remaining a free, lawful and Constitutional country is our system of educating our young.
But It's an abysmal failure I fear. All you need to do is look at every protest and you see very young people
screaming to disband ICE. Seems none have been educated about any facts of America.

Watching Waters last night asking kids around about history. None of them could answer, except very few.
I think they are college students. That is why millennials don't appreciate our country because they don't know history.
and I think, they know nothing about the constitution too.

They want democrat and socialist way, because they feed them with all propaganda. Free everything.

So much differences from those days when we were young.

Liberal progressives’ heads proceeded to explode throughout the U.S. Every TV and radio station had a Democrat Senator or consultant hyperventilating at the thought of President Trump getting to appoint another Justice to the Supreme Court. Maybe if the government wasn’t so involved in every person’s life, the fate of the Supreme Court wouldn’t be such a big deal?

The question to ask is why is the Supreme Court (SCOTUS) so important? The court is one of the three branches of government designed to check the other two institutions, the Presidency and Congress. As the highest court in the land, it is up to SCOTUS to ensure the other two branches of government do not violate the law of the land, the Constitution. Seems simple enough, but the more government interferes in the lives of people, the more there is for the Supreme Court to rule on.

What has happened to the court has put it in direct conflict with its mission. For decades, the court has made policy and wrote laws. Those are two areas the court is specifically not supposed to be involved in. The job of the court is to look at a law Congress passed, or policy being implemented by the Executive Branch and decided if it violates the Constitution in cases where there is merit.

Many of those complaining SCOTUS has too much power and they are right, but the court has the power it does because government has infected the lives of everyone in the U.S. Progressives have decided if they cannot win at the b****t box or the ideas cannot convince legislators, they will take it to the courts. The very people screaming about Trump taking away democracy are same people wanting nine unelected judges to rule on every aspect of life in the U.S.

Some of the more recent cases in front of the Supreme Court show just how powerful the government has become.

The Janus decision was based on people being forced, by the state and local governments as a matter of law, to pay union dues even if they didn’t want to or agree with the political message or even if they were not a member of the union.

The Obamacare decision was a case of big government getting involved in the lives of people, by forcing every American to purchase a product. The court rewrote the law to make that decision work.

In the Masterpiece cake decision, big government was once again forcing American citizens to do something against their will before that was overturned to uphold First Amendment rights to the freedom of religion.

All the most recent cases that riled people up had one thing in common, big government forcing people to act against their wishes.

It can also be argued President Trump owes his e******n to the power of the Supreme Court. Many conservatives were not keen on v****g for Trump in the e******n, but the idea of Hillary Clinton picking a Justice frightened them to the polls. One of the smartest political moves in history was for President Trump to publish a list of possible nominees to fill the vacant seat.

If government wasn’t so big, thereby making SCOTUS that much more important, maybe many conservatives would have stayed home on e******n day.

As everyone continues to lose their minds over the retirement of Justice Kennedy, they must ask themselves one question. Why is the most important issue in your life a judge? If Congress and the American people want to stop having heart attacks over the Supreme Court, quit giving government issues that make it to the court.

PS.. Congress makes law, not courts. The SCOTUS job is the check each law and verify it is constitutional and if not send it back to Congress.

I agree. None of the courts, at any level, should be making policy/law or ruling on their personal beliefs/desires. Congress should not be meddling in things not expressly within its responsibilities and should not be making laws/rules/policies without attention to input from the people. Government agencies need greater/tighter oversight and should not be given the power to make their own rules based on the political leanings of the top echelon. Lots of simple, operational changes need to be made everywhere. For example, why do the Supremes not work every day, why do they not carefully read/study/research/discuss every case before them, why do they take on so few cases?

Maybe because they can get away with it and clerks are the real supreme court and they are becoming LARP's. Who look at Congress and say they do why can't we. Trump is the only one of the three branches working 24/7. Maybe that's why his winning?
