Liberal Court Appoints Prosecutor in Bid to Jail Arpaio, Overturn Trump Pardon

The president’s power to pardon is absolute, but that isn’t stopping a coalition of liberal activists and a liberal federal court.

The Ninth U.S. Circuit Court of Appeals is taking the unusual step of appointing a special prosecutor to argue that former Maricopa County, Arizona sheriff Joe Arpaio’s contempt of court conviction should stand, despite being pardoned by Trump.

Arpaio was convicted in 2017 on charges of defying a federal court order to cease patrols of the U.S./Mexico border.

Trump quickly pardoned Arpaio. Liberal activists sued to overturn Arpaio’s pardon, claiming it violated their constitutional rights.

They not only want Arpaio’s conviction to remain on his record, but they also claim they can overturn the pardon in court.

The Justice Department sided with Arpaio, pointing out the president’s power to pardon in the case is unquestionable.

That’s when the court, in a 2-1 ruling, ordered a special prosecutor be appointed to argue against the pardon.

There is no precedent for such a case, and no p**********l pardon has ever been overturned in court. That’s because the Constitution unequivocally states the President “shall have Power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.”

That means, except in cases of impeachment, the President can pardon anyone for any federal crime, such as Arpaio’s federal conviction for contempt.

While the president could be prosecuted for selling a pardon or using one to obstruct justice, the pardon itself cannot be challenged.

Only one member of the three-judge panel dissented.

Judge Richard C. Tallman, an appointee of President Clinton, wrote, “I fear the majority’s decision will be viewed as judicial imprimatur of the special prosecutor to make inappropriate, unrelated, and undoubtedly political attacks on p**********l authority. We should not be wading into that thicket.”

But that isn’t stopping liberal activists groups from suing to overturn the Constitution and imprison Arpaio in an act of political vengeance.

Misuse of a pardon can have all kinds of political backlash. It's why presidents usually wait until their last week to roll out controversial pardons.

Another issue is that Trump is totally disregarding the process of properly filing and getting legal counsel, there is an entity whose job it is to review pardons.

Arpaio's was an entirely inappropriate use of a pardon considering it put the president in pure conflict with his oath to protect the constitution. This conviction was all about civil rights violations in the first place, so the president is out of step with what his job as president is.

Trump is undoubtedly going to want to pardon friends and family, so I'm surprised Trump was stupid enough to draw the attention to an abuse of that power, for a dikwad like Arpaio.

If he uses it to pardon a witness in the Russia investigation he will be challenged, he may have already stepped over that line sending messages that he "could" do such pardons. Yes he could but congress could impeach him for any reason they choose to, they need no proof of anything, just deciding that the president has gone too far on anything. Trump seems to think his powers are endless, he needs to realize that the powers of the senate and house are looser than he thinks if he goes to far.

Funny how easily the right disregards the concept of Justice, Arpaio got the conviction he had coming, it was justice for multiple civil rights violations, not to mention he cost taxpayers tens of millions of dollars.

Trump overturned the constitution pardoning someone who violated it in the first place. Now all of a sudden it's overturning Trump's pardon that is the violation? Please, the circular arguments and the stupid hurts.

If I remember my civics correctly, it is likely unconstitutional because it would be a violation of the “Separation of Powers” laid out in the Constitution.

Trump does not support Putin and Russia. I think you forget that Russia has atomic teeth. You better hope that those teeth are never used by either side. Common Sense tells me that it is better to engage Russia in some type of diplomacy and conversation instead of hollering all the time about how they interfered with our e*******l process. We keep forgetting how we meddle in other nations’ political processes, that includes Russia, in the world. This kind of monkey business has been going on since the beginning of the Cold War. Nations do it because they want to know what other countries are up to and how it might effect their security. If you use your brain a little, which I doubt you are cabale of doing, it might be a methodology nations use to keep the peace and the missiles in their silos.

Congress passes new sanctions t***p w*n't enact them .
Trump calls Russia says I'm going to send missiles into that old air base move you people
He fires 178 million dollars worth of missiles into nothing the field was open the next morning.
How many of his people with Russian contacts 19 how many have plead guilty how many more to be tried.
It would not surprise me if trump wasn't getting a payed by Russia
