All of you, who think only "inside the box" and believe the ACA is the best thing since pizza by the slice, may want to go on to another forum. This is not in the "box" and is a whole veggie pizza.
I keep reading so many comments concerning the ACA. The most popular one seems to be, "It is the law of the land." For the purposes of this topic, this will be the starting point.
The next point is what is civil disobedience? according to the the "free dictionary/legal-dictionary" it is defined as follows: "A symbolic, non-violent violation of the law, done deliberately in protest against some form of perceived injustice. Mere dissent, protest, or disobedience of the law does not qualify. The act must be nonviolent, open, visible, illegal, performed for the moral purpose of protesting an injustice"
Now, we come to the IRS. Starting in 2014, they will be the agency determining whether, if you have health insurance, such insurance meets the ACA requirements. It is the IRS who will determine if you will have to change plans or be fined. When your Federal Tax Forms are issued, the package will include a form (name and form number unknown to me) to be completed by you providing the IRS with the name of your insurance company as well as your policy number of such insurance plan. (requiring providing of such information is a violation of the HIPPA Laws) The bureaucratic hacks from the IRS will then determine and notify you whether your personally chosen health insurance plan meets the ACA requirements (for which you had ZERO input). These individuals,(who probably could not obtain employment in a real business), who know absolutely nothing about you, your family or the needs thereof, will make very personal family decisions for you.
Now we come to converging the three; ACA, Civil disobedience and the IRS.
The most recent number I have been hearing for the population of the US is 330 million. Being a generous person, we will presume 30 million of that number are illegal residents of the US, leaving us with 300 million legal residents. There have been any number of figures bandied about as to the number of individuals who will still remain ineligible for the ACA. Let us go with 30 million, which is the most recent number I heard. We are now down to 270 million legal citizens. Again, being a generous person we will presume of the 270 million one half will sign up for ACA. This now leaves us with 135 million people. I know you want the math to end; however, we have to do one more math problem. Of these 135 million citizens, we will go with 35 million may be getting a tax refund, hence will not participate in the next portion of this exercise of civil disobedience. We are left with 100 million citizens. I really like round numbers. :-D
Our act of civil disobedience is we WILL NOT send in the form requesting information regarding our health insurance coverage. What will these bureaucratic hacks do? They will first send a request informing you you failed to submit a required form and request you submit it forthwith. Again, we WILL NOT send such form in. They will then a second request with some type of law reference and a first threat. Yet again, 100 milion citizens DO NOT comply. A third request with stronger language will arrive and again, we DO NOT submit the requested form. At some point, the managers of these hacks will have to go the IRS Commissioner to determine what to do about these 100 million civilly disobedient citizens. Some new edict will be forthcoming and again, we DO NOT comply. The Commissioner will then have to go the Secretary of Treasury. Yowzer, I would love to be the wall in that room during that conversation. In my opinion, small though it may be, there is little the IRS can do against 100 million tax paying citizens. If the only thing you have done is leave one form out, paid your taxes and committed no other illegal acts, what is their threat. How do they enforce a threat against 100 million citizens.
I do not know about you, but I am really comfy here in my triangle as opposed to the "box".
