Show me what top constitutional lawyer says certification of electors by the state executive branch overthrows certification by the state legislative branch. Not only are the slate of electors certified by the legislative branch not "fake" electors, those illegally certified by the executive branch are not fake electors either so long as the slates of electors were chosen by their party in the way the designated in their state. Usually at the party convention or caucus. Each party chooses a slate of electors. The one selected in the manner chosen by the state legislatures under their authority, are the ones authorized to vote in December. This is clearly spelled out in our federal constitution, and in state constitutions as well.
Usually, but not always, the slate chosen is of the party the candidate winning the popular vote belongs to. When the outcome of the popular vote is not clear, the state legislature either calls for another election in their state, or makes a decision on which slate to choose. In my state of Arizona it was the latter our legislature chose. The Secretary of State, nor anyone appointed by the SoS, had no authority to certify electors. Neither does the governor or any other executive branch official whether elected or appointed. Nor does the SoS have the authority to write and enact laws which don't go through the legislature to be voted on
, including election laws.
Our then SoS, Katie Hobbs, wrote election laws a few months before the election making it mandatory to use Dominion voting machines, or machines with the same parameters and internet access, to count all but 2% of the ballots. This despite that many rural counties, including Cochise County where I am was a registered voter, have few or no such machines [NO DOMINION MACHINES] and heavily rely on hand counting as the citizens of the county voted on several elections ago. The SoS stated that the machines were more accurate than hand counting since they are certified by a test of a sample of ballots run through the machines then checked by hand counting to verify accuracy. If the machine count matches the hand count, it is certified accurate. The hand count is the standard the machines must meet
My county usually hand counts 75% of the ballots. In 2022 there was such a high turnout that there were not enough tabulators to count the usual 25%. Nor does my county have ANY Dominion machines. So the supervisors voted to count 90% by hand. Then 3 people not registered to vote in our county, in fact 2 were not registered to vote anywhere and the third was registered in a different state, made a complaint to a judge in Pima county about our county hand counting more than 2% of the ballots. The judge, from Pima county, placed an injunction to stop our county from counting ballots. This judge had no jurisdiction to do so, so our supervisors didn't comply. Within a quarter of an hour, our SoS, Katie Hobbs, who was running for governor, threatened to have the supervisors jailed if they counted one more ballot. She demanded the count be certified as is, disenfranchising hundreds of thousands of voters. One hour had gone by since the polls closed when the injunction came down and only 75,000 ballots had been counted. I was a volunteer poll worker so know this first hand. The supervisors made an emergency appeal to lift the injunction and let the voter's ballots be counted, whether by hand or machine. The court refused to see the case as an emergency and put the appeal on the docket to be seen the earliest in a few weeks, but possibly a few months. Our supervisors held out until arrest warrants were issued under the order of Hobbs. They certified the vote. My vote was one of the ones never counted.
Maricopa County had even a greater number of irregularities.
Trump is saying he won the election. As for the general election, there has been a great deal of evidence of massive fraud in multiple states. But even if fraud is proven and the courts agree, that doesn't prove he won the election. Instead it means we don't know who won. And as for the electors votes, Pence CHOSE to read the votes of the electors in several states who were NOT legally certified instead of the ones certified by the state legislatures. He did this while making a big todo over how he had no authority to choose who won the election. Yet he CHOSE which votes to read despite that there were well over a hundred challenges by members of congress both in the House and Senate.
So constitutionalists like myself communicated to our representatives that we expected them to abide by our constitution during the joint session on January 6th. The violence, such as breaking windows, gave them the excuse to ignore our constitution and read the unconstitutional votes.
Did Trump win? We will never know because the constitutional votes were destroyed.
