President Donald Trump announced that evidence of alleged election fraud will be presented on Jan. 6 during the Joint Session of Congress.

“Massive amounts of evidence will be presented on the 6th. We won, BIG!” Trump wrote on Twitter.

It comes as Sen. Josh Hawley (R-Mo.) and about 40 House GOP lawmakers have announced they would challenge the Electoral College votes during the Jan. 6 Joint Session of Congress due to alleged fraud and irregularities during the Nov. 3 election. The challenge could lead to several hours of debate during the session.

The challenge is supported by Trump, who, in recent weeks, has met with House lawmakers, including its chief sponsor Rep. Mo Brooks (R-Ala.), at the White House.

Trump’s adviser, Jason Miller, told Newsmax earlier in the week that the team is aiming to present more evidence.

“We will have a chance in front of the American people, next week to present these cases, all these evidences of fraud,” Miller said, pointing to a lawsuit filed by Rep. Louie Gohmert (R-Texas) against Vice President Mike Pence earlier this week to prevent him from confirming Joe Biden’s electoral victory. Pence’s lawyers with the Department of Justice later said Pence isn’t the person who should face a lawsuit, arguing that Gohmert should have sued Congress.

If Hawley and the other lawmakers challenge a state’s Electoral College votes, Trump’s campaign will make their presentation. The challenge requires a senator and a representative to carry out.

Miller pointed to law changes regarding mail-in ballots in Wisconsin and other states, “suitcases of ballots” in Georgia being wheeled out late at night on Nov. 3 in Atlanta’s State Farm Center, and officials in Michigan and Arizona allegedly blocking them from inspecting voting systems. State election officials in those states have denied claims from the Trump team and third-parties about voter fraud and irregularities.

“These are the specific types of evidence we want to present to the American people on the national stage and not allow local politicians to sweep it under the rug,” Miller said on the program.

Miller and Trump did not elaborate on how they would present that information to Congress, or whether they will be able to do so.

The president, in making his announcement for Jan. 6, retweeted Hawley’s post where he said that millions of Americans are “concerned about election integrity” and “deserve to be heard.”

“Somebody has to stand up. 74 million Americans are not going to be told their voices don’t matter,” Hawley also stated.

Trump has also suggested that his supporters attend rallies and events on Jan. 6, including one in Washington D.C. at 11 a.m.

I hope VP Pence who is in charged on Jan 6th will act according to the laws of the constitution vested on him. The frauds were overwhelming, and there is no doubt it went beyond the claimed number of Biden's stolen victory.

Anybody in Congress who continue denying these violations has no duty to continue its duty to be in Congress. This is the most important part of our history cause this resolution if not followed accordingly, will result to the demise of our constitutional-republic.

I think that these elections are not about Democrats and Republicans, rather it is about who defends the country and who wants to deliver it. I believe that there are Democrats who do not agree with what is happening and that there are Republicans who do. As much as they have tried to cover it up, it is a scandal of great proportions that the elections have been fraudulent. Everyone knows it, Democrats, Republicans, the media, the judges; and most importantly: the majority of Americans; of course, there are those who have been misled by the propaganda that has satanized a man because he has said what the majority wanted to hear and was elected, even though his opponents cheated.
The media, politicians and judges have been intimidated, others have been bought and many are afraid that their involvement in dark affairs will be discovered. Very few are blameless.
Next day 6, no matter what is said. Words, reason and justice do not exist in a deeply corrupted environment. The evidence of fraud can be enormous, but those who committed it and those who support them (for one reason or another) do not want to recognize it; and neither will they do it in Congress.
There are two paths here: the force of justice or the justice of force.
Whoever has force on his side will be the winner, to the detriment or benefit of the country and all its inhabitants.
Will the patriots surrender this country without a fight? Will the armed forces be satisfied that the country submits to the interests of its enemies? We will soon know.

It's for Mike Pence to Judge whether a Presidential Election Was Held at All

On January 6, a joint session of Congress will open with Vice President Pence presiding as president of the Senate. His power will be plenary and unappealable. You heard that right. As president of the Senate, every objection comes directly to him, and he can rule any objection "out of order" or "denied." His task will be to fulfill his oath of office to protect and defend the Constitution of the United States and to ensure that the laws be faithfully executed. This is a high standard of performance, and V.P. Pence will have two choices. He can roll over on "certified" electors, or he can uphold the law.

Article II, Section 1 of the Constitution gives state legislatures "plenary authority" as enunciated in Bush v. Gore. This is key, since the counting of votes is discussed in Article II, the 12th Amendment, and 3 USC 15. To this we must add the history of counting and objections recounted by Alexander Macris (here and here). Put bluntly, it's as clear as mud. Add to that the fact that the contested states of Arizona, Georgia, Michigan, New Mexico, Nevada, Pennsylvania, and Wisconsin have sent dueling slates of electors to D.C. This means that the V.P. has to decide how he will handle the situation when two sealed envelopes are handed to him from any of those states.

Macris points out that in 1800, even with constitutional deficiencies in Georgia, Thomas Jefferson blithely counted defective electoral votes from Georgia, effectively voting himself into the presidency. This demonstrates that the president of the Senate is the final authority on any motions or objections during the vote-counting. There is no appeal. That doesn't mean there won't be any outrage. Whatever Pence does, people will be angry. But what does the law demand?

Seven contested states clearly violated their own laws. Rather than list the facts, which have been detailed in multiple articles, we must consider the following:

An election is a process of counting votes for candidates. Only valid, lawful votes may be counted. A valid lawful vote is:

Cast by an eligible, properly registered elector as prescribed by laws enacted by the state Legislature.

Cast in a timely manner, as prescribed by laws enacted by the state Legislature.

Cast in a proper form as prescribed by laws enacted by the state Legislature.
Any process that does not follow these rules is not an election. Anything that proceeds from it cannot be regarded as having any lawful import.

Most commentators suggest that a process of collecting pieces of paper with marks on them is an election regardless of errors, omissions, and even deliberate malfeasance. This is a mistake. Imagine a golf tournament where every bad shot by one player gets a do-over, but the competing player has to follow USGA rules in detail. One player gets to drop freely out of hazards, but the other has to tackle every embedded ball as it lies. The result is a travesty.

The same thing applies to elections. If there are a handful of improper votes, we can suggest that there was in fact an election, perhaps tainted, but the election wasn't materially harmed. But when the people charged with managing the election decide to ignore the law, whatever process they supervise is not the process defined by the law. Therefore, it is not an election.

This leaves V.P. Pence with a dilemma. He is a gentleman who regards our governmental traditions with a degree of reverence, so he will be reluctant to take any bold action. But as an honorable man, faced with massive illegality, he must act to protect the law. Consider how things might go down as the two closed envelopes from Georgia are handed to the V.P. Rather than opening them, he says:

In my hand are envelopes purporting to contain electoral votes from Georgia. They are competing for consideration, so it is essential that I consider the law that governs this. That law, according to the Legislature of Georgia and Article II, Section 1 of the U.S. Constitution is the Georgia statute that includes procedures for signature-matching on absentee ballots, a requirement that all absentee ballots be first requested by a legitimate voter, and that election monitors be meaningfully present at all times while votes were counted.

The Georgia secretary of state, who is not empowered by the U.S. Constitution to make changes to election law, entered into a Consent Decree that gutted these protections enacted by the Georgia Legislature. The processes that he prescribed and were ultimately followed were manifestly contrary to that law. Further, the State of Georgia, in unprecedented concert with other states, suspended counting of ballots in the middle of the night, covering its conspiracy with a false claim of a "water main break." We now know from surveillance video that many thousands of "ballots" were counted unlawfully in the absence of legally required observers.

Finally, the State of Georgia, under the authority of secretary of state Brad Raffensperger, a non-legislative actor, used fatally flawed Dominion voting machines that have been demonstrated to be unreliable. In testing, the error rate of Dominion machines has exceeded 60%, far in excess of legal limits. They are designed to facilitate fraud without creating the legally required paper trail. This alone is far more than enough to swing an election.

Since the state of Georgia has failed to follow the election law established by its legislature under Article II, Section 1 of the Constitution, it has not conducted a presidential election. Therefore, no "presidential electors" were appointed in Georgia. Further, "electors" "certified" by non-legislative actors pursuant to this process are in fact not "presidential electors." The competing slate of "electors" is similarly deficient, having not been elected through a presidential election.

Therefore, the chair rules that Georgia has not transmitted the votes of any presidential electors to this body. Georgia presents zero votes for Donald Trump and zero votes for Joseph Biden.

The central point is that the VP, as the presiding officer and final authority, has the unquestionable authority to declare that the states in question have not conducted presidential elections. There will be wailing and gnashing of teeth, but no one has the authority to override his decision.

The statement says nothing about who might or might not have "won" the contested states. Rather, by not following their own laws, as enacted by their own legislatures, they have violated Article II, Section 1. Thus, they have not conducted an election, and their results are void.

If the votes of all seven contested states are registered as zero, President Trump will have 232 votes, and Joe Biden will have 222. The 12th Amendment says, "[T]he votes shall then be counted[.] ... The person having the greatest number of votes for President, shall be the President[.]"

In plain language, Donald Trump will be re-elected, since he has a majority of the actual electoral votes. There will be no need to involve the House of Representatives to resolve a contingent election.

Richard Nixon chose not to contest the 1960 election because he felt that winning that way would lead to an ungovernable country. If V.P. Pence does this, that same argument might be made. But is the country governable even now? Blue states such as California, Oregon, Washington, New York, New Jersey, and Michigan are already operating in an openly lawless manner with their "emergency" "COVID-related" restrictions. Their denial of the civil rights of law-abiding citizens is horrific. Their refusal to do basic policing and law enforcement is a recipe for open war. How much worse would things be if the V.P. lived up to his oath and upheld the law?

The situations that occurred in 1960 and 2000 are not at all the same as the one we are facing today. At present a case similar to that of 1860 is presented, when Abraham Lincoln (having been elected) did not hesitate to face secession. Now it is not secession but handing over the dominion of the country to a foreign power that is worse.
If Pence does not act correctly, he is going against his own interests.
His political career will be over. However, if he does well, he can think about becoming President. What would never be possible if he allied himself with the enemies of the USA.
In something I do agree with you Siciliano, to ensure that there are no surprises, the President should implement the Executive Order issued in 2018 on the possibility of interference in the elections, as well as implement Martial Law in the places that are convenient and especially in Washington DC, no later than January 2.

Better yet, following the 12th amendment: “The person having the greatest Number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed…..”

After seeing the brazenness with which the Supreme Court ignored the Texas lawsuit, little remains to be seen. Hopefully there will be a problem in the joint session of Congress on January 6.
I estimate that on January 2, the President should enforce the Executive Order on Election Irregularities and declare Martial Law where necessary, starting with Washington D.C.

You're right, it's not rocket science or secret cabal, you just have to know how to read, read everything and interpret it. You need to read the following: "in the way its legislature provides." When the legislature casts a vote against the state executive, it is a sign that the provisions of the legislature have not been followed.
The Executive has certified elections that have been protested for fraud.
Thus, when the Vice President receives two certifications from the same state, he can determine that neither of the two is accepted. Who selected the Electoral College members in the states of Wisconsin, Michigan, Pennsylvania, Georgia, Arizona, New Mexico, and Nevada?
The Constitution says: (Article Two, First Section [2] Each State shall appoint, in the manner that ITS LEGISLATURE PROVIDES, a number of electors equal to the total number of senators and representatives to which the State is entitled in Congress… .or, as which is the same: The president and vice president will be elected by an Electoral College, whose members have been selected or appointed by the legislative Assemblies of the states.

Before the election, and for a short time afterwards, the Trump campaign was represented by highly regarded “white shoe" law firms such as Jones Day, Snell & Wilmer, and Porter Wright Morris & Arthur. I can assure you their documents would have been of the highest quality.

By November 13, all these firms had removed themselves from the Trump campaign, concerned that the increasingly crazy demands of the campaign would damage their reputations.

They were replaced by Trump's Elite Strike Force;


Rudy Giuliani: trafficker in Russian disinformation conspiracy theories.

Sidney Powell: trafficker in Q-Anon conspiracy theories.

Joe DiGenova and Victoria Toensing: Fox News lawyers to indicted Ukrainian oligarch Dmytro Firtash.

Jenna Ellis: Fox News lawyer and former traffic court attorney.

They were assisted by the likes of:

L. Lin Wood, celebrity defense lawyer and armed revolt proponent.

John Eastman, who famously claimed that Kamala Harris could not be Vice President because her parents were immigrants.

So this was the rag-tag band of conspiracy theorists and devoted Trumpists, selected for their religious zeal rather than any real legal competence.

Their documents were cobbled together from a disparate array of conspiracy theories and pseudo statistics flowing in from an army of MAGA fanatics.

With star witnesses like the always lovely and polished Melissa Carrone:

The last time I was researching foreign debt, I could see that Mr. Obama had doubled its amount. It was left by him at a figure very close to 20 trillion, with Clinton and especially Bush having contributed slightly less than half the amount mentioned above. I am not a Clinton or Bush supporter, but I am less of a supporter of the "Dark Star" [a more proper name for Mr. Obama, thinking in what becomes of a dark star according to Astronomy, and taking in account his racial complex], who made a terrible administration of this country. He surpassed Mr. Carter in the stigma of being one of the worst presidents in the history of USA, since Carter at least got the Nobel Prize for something he did and not for the color of his skin.

I think that the President would be happy to sign immediately what can be written on two sheets of paper. Support of 2000 USD for each American and support for small businesses. Of course this is not possible, because it would make him look good and not the politicians who want their cut in the business that represents what is approved for matters other than the main purpose of the aid.

I think that the voters in Georgia will realize perfectly who was putting up with the aid for months, and then showing up with total impudence, giving half of what was given the first time; and distributing money by the handful for other countries and for matters that have nothing to do with helping the American people.
