NY Prosecutor's case against Donald J. Trump is a violation of the NY State Constitution. This case has numerous grounds to be over turned. Trump should sue for malicious prosecution and seek $ 10 Billion. He also should sue for interference of a Federal Election. He is being prosecuted solely because Joe Biden is likely to lose to Trump in the Presidential election.

" What other crime? The penal statute in question doesn’t say. That’s a fatal problem because New York State’s constitution mandates that a statute must spell out any statutory terms it is incorporating. Under Article III, §16, of the state constitution, incorporation by reference is not permitted. "

Yep. I posted one about the same not too long ago. Problem is you have a highly conflicted judge who don't care about rule of law.

There is little doubt that Donald J. Trump will be convicted. The jury pool all but guaranteed that. Ultimately the conviction will be overturned. What I do not know is whether the conviction will be used to keep him from assuming office when he beats Joe Biden. That period between conviction and overturning is legal wilderness. That is where Trump's running mate becomes key. That person may become the sitting President.

You're saying a conviction could keep him from office?

According to the U.S. Constitution, anyone who is at least 35 years old, a natural-born citizen of the United States and a U.S. resident for at least 14 years is eligible to be elected president. Because the Constitution does not mention criminal records, a person indicted or convicted of a felony would not be barred from serving in the role so long as he or she meets the other requirements.

I've posted this on a couple of other posts here. IF DJT if found guilty, pillsbury dough boy Bragg will post......

"Today Donald John Trump was found guilty of SOMETHING. We can't release what that is as THAT is classified. We'd like to thank the public who stood by us for the last 10 years as we manufactured evidence. Jurors will be paid a bonus for their biased opinions."

I am not saying anything. The Democrats will say that a felon cannot serve in the White House, especially if he is serving times in a NY State Prison. We will be in uncharted legal waters after Bragg's impartial jury convicts Donald J. Trump.

After the conviction, it will go through the NY Court system and then likely to the US Supreme Court, where finally it will be overturned. During that time period, I have no clue whether Trump can serve as President.

And how the hell would a misdemeanor result in jail time?? Even democrats say it's unlikely

I suppose they could do street work or something . It isn't much more than a misdemeanor and I can't believe they would send someone to jail for it.

I just thought of something. When you said misdemeanor, I remembered " High Crimes and Misdemeanors. " In the Constitution Impeachment of government officials including Presidents uses that phrase as grounds for removing one from office.

I believe that if Trump is convicted even of a misdemeanor Democrats will argue since that is grounds for Impeachment, it is also a reason for refusing to seat Trump. Even then I think the Supreme Court would seat Trump and force Democrats to Impeach him.

I am talking out of my ass, but I say my scenarios are all plausible. I yield the floor.

Yea they will try anything. I remember Kevyn saying one time that an impeached president can't retake office.
