The capitol Police, Capitol Police board and ultimately Congress knew or at least should have known that Byrdwas prone to misbehave in a dangerous or otherwise incompetent manner.
Less than two years before in Feb. 2019, Byrd left his loaded Glock 22 (the same firearm he used to murder Ashli Babbitt) in a restroom in the Capitol Visitor Center (CVC) complex. Byrds loaded Glock was discovered during a routine security sweep later in the day. Lawmakers and staff charged with oversight of the USCP were made aware of the security breach until questioned by a reporter.

Byrd's police powers had been revoked more than once for failing to meet USCP's semi annual firearms qualification standards. USCP range requirements give an officer who fails to meet the standards one week's remedial firearm training. Failure to qualify after that results in police powers being revoked until the officer qualifies. Byrd had a reputation for being a poor shot by his peers. I guess poor Ashli Babbitt never got the word!
Byrd's police powers were also revoked for a prior off duty shooting into a stolen moving vehicle in which the occupants were teenage juveniles. The stolen vehicle belonged to Byrd. Byrd fired multiple shots at the fleeing vehicle in a suburban area. Stray bullets from his firearm struck homes nearby. An official investigation found his flagrant use of force UNJUSTIFIED!
