It seems that I have a new neighbor to the West of me. I didn't know it until today. I was outside doing some work when I noticed an orange stake at my back fence, so I went to see what the what. A guy, prolly 200 yards away on the other property is yelling, and waving at me. I waved back, and went about my business.
Long story short, the guy showed up at my front door puffed up like a Banty Rooster, talked smack to my wife (I was out back), and then came to where I was, and came at me with complete attitude because he claims his survey shows that my fence is 3 inches over his property line. He talked funny, so, I asked where he is from, and he said New Hampshire. I tried to be reasonable with him, but, he's DEMANDING that I move a little over 600 feet of fence that's been here for over 40 years.....3 inches.
This guy got so loud, belligerent, and demanding that my wife called the Sheriffs Dept on him because she thought it might get physical. This was a two hour ordeal over 3 inches of fenceline.
Is everyone from that part of the country that way? If so, stay there. Otherwise, you might try to bully someone with less patience than me, and catch a hammer upside the head.

If that fence has been there for forty years you have been maintaining the fence and 3" of property on your side of the fence, you now own that 3 inches and have for a long time. Adverse possession. The length of time for adverse possession varies by location. But generally somewhere around 7 to 20 years. If you want to lay claim you should get a survey done to include the 3 inches and file a corrected title. If you want to be neighborly and if he wants the 3 inches back, You could always sell it back to him for the cost of the fence.

That property back there has been vacant for 20 years. Apparently, this cocky jackass bought it, and is going to build a house there. It's 10 acres bordering my 5 1/2. 3 frigging inches this guy is talking about. I now, have to dig out the survey papers from when I bought this place 33 years ago. That fence was there when I bought the place.
I'm madder about his attitude than the 3 inches. And, now, I'll go full blown Caitlin Jenner before I move that fence!!
Lol!! I LITERALLY had a 3 pound hammer in my hand when that dude stormed around there, and started in on me like some kind of intimidating badass. It was really kind of funny. The accent, the bravado, the balls, all that.
The deputy was pretty patient with him as well, while attempting to explain to him about being trespassed from my property.
I dunno, we'll see how he does. I'm thinking he didn't move into a friendly neighborhood.
This is Texas. We're a little different here. You push, we'll shove.
This could be fun!! 😁

If the fence actually is on his property, it is his fence, not your problem.

Gee Arch, I live in NH and everyone I meet is very kind. Maybe we should avoid sweeping generalizations and conclude that there are a few aholes everywhere that ruin it for everybody. I'm sure everyone in Texas isn't pure as the driven snow ❄️

I thought that immediately upon reading it. In NYC, new buildings had to be set back from the property line a certain distance. As a result of that, part of the area property line became walkways for pedestrians. Regularly, the building owners would have small pylons placed at the property line so that the walkway area, didn't become public domain.

But please. I understand that I am a New Yorker but there are jerks everywhere. Just look at the Clintons, Durden, Newsom, Romney, Cheney, etc.

When I was in the construction business in Palm Beach County, a lady in Palm Beach had a lawyer move in next door to her.
The same problem, a matter of a few inches.
She was the largest shareholder of Sony at the time, we moved her fence for no charge, it was only six feet long.

If you didn't put up the fence, and it's not on your property, what's the beef?
It's his fence. He can move it or tear it out.
Not your problem.
I always put up my fences giving up those inches so that there's no dispute.
I couldn't give a dang about a few Sq feet
