Donald Trump has been taken off the ballot for the Colorado primary, because the court declared that Trump waged an “insurrection” against the US government. I’m stunned at how many people are just freaking out against this ruling, especially noted legal scholars, who didn’t take 15 minutes to read through the actual decision. Donald Trump is on the ballot in Colorado and he’s going to stay on the ballot in Colorado. Here’s why.
On page 9 of the ruling, the court issued a stay against its own ruling. To maintain the status quo pending any potential decision by the US Supreme Court, the Colorado Supreme Court issued a temporary stay against its ruling until January 4, 2024.
Here’s what the ruling says on page 9:
“If review is sought in the Supreme Court before the stay expires on January 4, 2024, then the stay shall remain in place, and the Secretary will continue to be required to include President Trump’s name on the 2024 presidential primary ballot, until the receipt of any order or mandate from the Supreme Court.”
The second that this ruling came down, President Trump and his attorneys announced that they are appealing it to the US Supreme Court. That keeps the Colorado Supreme Court’s stay in place indefinitely. By the time the Supreme Court even gets around to putting this case on its docket, Colorado’s primary election will be over. Trump will be on the ballot, and he’s going to win in Colorado.
This was nothing more than a partisan political stunt by the Democrats on the Colorado Supreme Court. The ruling was completely partisan, 4-3. The Colorado Supreme Court knows, just as the high courts in other states have already ruled, that state supreme courts do not have the authority to pick and choose between presidential candidates. They just did this as a stunt to make the hearts of Democrat voters flutter.
The ruling also declares Trump to be guilty of insurrection, which was odd. He’s never been charged with insurrection. No law enforcement entity, including the crazed special counsel Jack Smith, has ever even accused Trump of insurrection. He certainly hasn’t been convicted of insurrection.
Insurrection is a specific crime. You can’t just declare someone guilty of it. The idea that the Supreme Court would somehow uphold this ruling is preposterous.
Next, the Colorado Republican Party immediately announced that if Trump is removed from the ballot, they will withdraw from the primary as a party and hold a pure caucus like Iowa. Ballots would be irrelevant in that situation. Trump would simply be a candidate like any other in that situation, and he’s allowed to caucus because he is a legitimate candidate.
I really have to hand it to Ramalamadingdong on this one. Vivek Ramaswamy clearly read the court ruling and he knows that Trump is going to be on the ballot no matter what happens. So, he announced that if Trump is off the ballot, he will withdraw from the Colorado primary. He then demanded that Christ Christie, Ron DeSantis, and Nikki Haley all do the same, “Or else they are tacitly endorsing this illegal maneuver which will have disastrous consequences for our country.”
That was pure cutthroat politics right there. Ramaswamy knew that Trump is going to be on the ballot, so there was no personal risk to him in pledging to drop out. But since nobody else bothered to read the fake ruling, everyone thinks he’s making a promise that has skin in the game. It doesn’t, but it looks great. Nice job.
It’s too bad that Ramaswamy is an anchor baby and therefore ineligible to be President of the United States. He could be a really good contender in 2028, based on his political instincts.
Putting everything else aside, this further delegitimizes the Biden regime here at home and abroad. Upon hearing about the Democrats’ banana republic tactics against Trump, El Salvadoran President Nayib Bukele announced, “The United States has lost its ability to lecture any other country about democracy.”
He’s absolutely correct. It’s not a democracy if we’re not allowed to vote for the candidate of our choice."
